劳动教养执行检察监督制度研究

【摘要】： 劳动教养是对有违法和轻微犯罪行为人实行强制性教育改造的中国特有一种法律制度。劳动教养执行是指有劳动教养执行权利的部门对违法和轻微犯罪行为人进行矫正违法行为的过程。近半个世纪来,通过执行劳动教养制度教育、感化和挽救了一大批违法犯罪人员,为巩固新生的人民民主政权,促进社会主义依法治国进程起到了非常重要的作用。然而,劳动教养执行制度尚未完全适应我国法治进程的需要,在劳动教养执行过程中缺乏监督检察制度约束,以致于劳动教养执行过程中权力腐败影响社会公平正义,侵害当事人的权益,它与我国日益重视人权的司法保护发展趋势不符。本文试图通过对我国劳动教养执行制度的历史和现实考察,剖析其存在的理论缺陷与实践不足,并从理想与现实结合的视角,对探索建立劳动教养执行检察监督制度的路径和方法做出了大胆设想。本文共分为四个部分：第一部分是对劳动教养制度的形成做了简要概括,从而总结归纳出劳动教养执行的概念、性质和特征。文章对劳动教养法律地位进行了概括并对工作实践中劳动教养执行中存在的问题进行了重点分析。第二部分对劳动教养执行引入检察监督的必要性、可行性和现实性以理论和现实相结合的方式进行了详细的剖析和探讨。第三部分对劳动教养执行的立法现状进行了简要概括,并将其与国外相似制度进行了比较。文章归纳了劳动教养执行检察监督缺失导致的困惑,并对造成这种情况的原因深入进行了分析和探讨。文章还对当前劳动教养执行检察监督方式缺失及原因进行了分析研究。第四部分重点提出了对劳动教养执行检察监督制度的构想,并从立法原则、指导思想、具体制度、相关措施及程序进行了大胆的设想,指出应将检察监督尽快引入劳动教养执行中,不断完善劳动教养制度的合法性和合理性,最终实现构建公平正义的有序社会。
[Abstract]:The reeducation through labor is a unique legal system in China which has compulsory education reform for people with illegal and minor crimes . The implementation of reeducation through reeducation is the process of correcting the illegal and minor criminal acts . This paper is divided into four parts :

The first part is a brief summary of the formation of the system of reeducation through labor , so as to summarize the concept , nature and characteristics of the implementation of reeducation through labor .

In the second part , the necessity , feasibility and reality of introducing procuratorial supervision into the execution of labor education are analyzed and discussed in detail with the combination of theory and reality .

In the third part , the present situation of the legislation of reeducation through labor is briefly summarized and compared with the foreign similar system . The article sums up the confusion caused by the lack of supervision and supervision of labor education , and analyzes and discusses the causes of this situation .

The fourth part puts forward the idea of carrying out the procuratorial supervision system for the reeducation through labor , and carries on the bold idea from the legislative principle , the guiding ideology , the concrete system , the relevant measures and procedures , and points out that the procuratorial supervision should be introduced into the implementation of the reeducation through labor as soon as possible , and the legitimacy and rationality of the system of reeducation through labor should be perfected , and the orderly society of fair and justice is finally achieved .
