【摘要】： 网络生活方式的普及是科技、社会发展的重要体现形式,网络社区逐渐成为人们不可或缺的生活、娱乐平台。网络社区之中人们的互动具有极高的拟真性,因此必然存在某些稀缺物品的需求以及物品之间、物品与服务之间、服务之间的交易,它们两者共同促成网络虚拟财产的产生。网络虚拟财产具有相当的价值,可以与现实世界中的财产和货币兑换、交易,因此存在较大的需求空间形成了较稳定的利益链条。由于有利益的地方就必然有犯罪的滋生,这样面对网络虚拟财产所蕴含的极大利益诱惑,致使许多社会中的不安定份子选择铤而走险走上犯罪道路。针对网络虚拟财产的犯罪以网络盗窃居多。盗窃网络虚拟财产犯罪,由于其产生、实施过程中参入有高科技成分,从而使得它与传统型的盗窃犯罪相比具有相当的新特点:从盗窃网络虚拟财产犯罪的犯罪人角度来说,第一,犯罪人平均年龄普遍呈现低龄化特点。据统计,我国的计算机犯罪者,平均年龄也是25岁;第二,犯罪人普遍掌握较高计算机技术,能够较为熟练的掌握一些具有较高科技含量的计算机软件、工具。从盗窃网络虚拟财产犯罪的被害人角度来说,被害人主要包括经常上网特别是经常玩网络游戏且大多是属于对计算机知识不太了解的人;被害人的主观方面的特征主要表现为法律意识不强、粗心大意、贪图小便宜等方面。从盗窃网络虚拟财产犯罪的手段特性角度来说,其主要类型包括原始型和高科技型两种,且具有相当的新颖性和隐蔽性。从盗窃网络虚拟财产犯罪的犯罪对象来说,主要有电子货币、虚拟物品、电子账户几种类型,这些对象都包含有较高的科技含量,因而是有相当的新颖性的。盗窃网络虚拟财产犯罪产生原因复杂,从其社会原因来说,主要有社会针对盗窃网络虚拟财产犯罪的认识不足、针对盗窃网络虚拟财产犯罪的立法有所疏失,政府对网络空间监管乏力、针对盗窃网络虚拟财产犯罪的司法打击力度疲软等几个方面。同时社会防治盗窃网络虚拟财产犯罪也有客观困难。从盗窃网络虚拟财产犯罪的被害人方面的原因来说主要有被害人的网络技术水平较低,被害人对网络犯罪防范意识较低等方面。盗窃网络虚拟财产犯罪猖獗因此必须有针对性的提出相应地防治措施方案。一方面来说要做好对该类犯罪的事先预防工作措施,主要包括以下几点:首先,应当切实提高立法重视程度;其次,着力加强对网络虚拟财产的监管;再次,加强对民众的防范意识教育;最后,加大对民众的计算机网络基本技术普及教育的力度。另一方面来说要加大对该类犯罪的事后打击力度。首先,要加大对网络虚拟财产犯罪的司法打击力度;其次,要努力提高国家机关监管、侦查盗窃网络虚拟财产犯罪所必须的技术、设施水平。盗窃网络虚拟财产犯罪与现实中的犯罪一样,不仅可以预见,同时也是可以被预防控制的。对付这种犯罪时大可不必由于其高科技属性而产生不必要的顾虑。对盗窃网络虚拟财产犯罪的防治需要社会各界联手群策群力制定出符合实际,符合中国国情的刑事策略,以有效的防治该种犯罪,避免其进一步扩散蔓延造成更大的损失。
