劳动教养的过去、现在与未来

【摘要】: 劳动教养制度自成立50余年来,历经风雨,共计教育挽救了500万余名轻微违法人员,取得了辉煌的成绩,为预防和减少犯罪,维护社会稳定发挥了不可替代的作用。然而随着现代法治与人权的发展,劳动教养制度已难于适应时代的发展,需要进行深入的改革。对于如何改革劳动教养,许多专家学者存有不同争议。本文全面回顾了劳动教养过去,客观地反映了劳动教养的现状以及存在的问题,分析了专家学者对劳动教养改革的不同见解,对劳动教养的未来之路提出了自己的一些具有创新性建议。 本文由三部分组成,具体内容如下: 第一部分:劳动教养的过去。回顾了劳动教养所经历的创办、大办、基本停滞、恢复发展、发展壮大的曲折之路。 第二部分:劳动教养的现状。介绍了劳动教养的基本状况,当前变化,主要经验做法,劳动教养制度在法律、法规、实践中所存在的弊端。 第三部分:劳动教养的未来。分析了当前关于劳动教养改革的保留论、废除论、改革完善论的三种不同争议,并对几种争议的进行了评论。笔者认为:改革是劳动教养未来的必由之路,只有通过包括立法、刑事政策、执行方式在内的全面改革,将劳动教养与社区矫正、收容教养等各种刑事执行措施综合调整,才能理顺当前刑罚执行的混乱局面,为劳动教养的未来找到一条光明之路。
[Abstract]:Since the establishment of the re-education through labor system for more than 50 years, after the wind and rain, a total of 5 million minor offenders have been saved by education, which has made brilliant achievements, and has played an irreplaceable role in preventing and reducing crime and maintaining social stability.However, with the development of modern rule of law and human rights, reeducation through labor system has been difficult to adapt to the development of the times.Many experts and scholars have different disputes about how to reform reeducation through labor.This paper comprehensively reviews the past of re-education through labor, objectively reflects the present situation and existing problems of re-education through labor, and analyzes the different opinions of experts and scholars on the reform of re-education through labor.Some innovative suggestions are put forward for the future road of reeducation through labor.This paper is composed of three parts, the specific contents are as follows:The first part: the past of reeducation through labor.This paper reviews the tortuous road of establishing, running, basically stagnating, restoring development and developing and expanding through reeducation through labor.The second part: the present situation of reeducation through labor.This paper introduces the basic situation, current changes, main experience and practice of the reeducation through labor system, and the drawbacks of the system in law, regulation and practice.The third part: the future of reeducation through labor.This paper analyzes three different controversies on the reform of reeducation through labor: reservation theory, abolition theory and reform and perfection theory, and comments on several kinds of controversies.The author believes that reform is the only way to reform the future of re-education through labor, only through comprehensive reform, including legislation, criminal policy, the way of implementation, such as reeducation through labor and community correction, the rehabilitation of all kinds of criminal measures such as comprehensive adjustment.Only in order to straighten out the current chaotic situation of penalty execution, find a bright road for the future of reeducation through labor.
