犯罪主观心理的要素分析方法

【摘要】：犯罪的主观心理分析,经历了从单一犯罪心理到诸多犯罪心理的发展后,又出现了犯罪分析法到要素分析法的新变化。与要求具体犯罪构成要件中仅能有一种罪过心理的传统犯罪分析方法不同,要素分析法认为,不同的客观要素可以具有不同的主观罪过,一个犯罪构成中可以同时存在多种主观罪过形式。采用要素分析法,能更好地解释复杂罪过、加重结果犯的主观罪过、主观的超过要素等问题,还能为刑法疑难问题提供新的思考路径。
[Abstract]:The subjective psychological analysis of crime has experienced the new change from the criminal analysis to the factor analysis after the development of the single criminal psychology to many criminal psychology. It is different from the traditional crime analysis method, which is only able to have a kind of crime psychology, and the factor analysis method holds that different objective elements can be made up. There are different subjective crimes. In the constitution of a crime, there are various forms of subjective crime. The use of factor analysis can better explain the complex crime, aggravate the subjective crime of the result offense and the subjective factors, and can also provide a new way of thinking for the difficult problem of criminal law.
