【摘要】： 随着改革开放的深入和社会主义市场经济的发展,生活于边远闭塞地区的少数民族人口开始向东部地区和大中城市流动,少数民族流动人口的迅猛增长以及地区之间、城乡之间广泛而频繁的少数民族人口流动行为,已经成为国内重要的社会经济现象。流动人口是社会学、经济学、城市学、人口学等许多传统学科研究的重要问题之一,也是民族法学这一新兴学科关注的重要问题。城市作为不同民族和各种文化的主要交汇点,是民族关系问题的主要引发区。如何做好少数民族流动人口的管理和服务工作,充分保障他们的各项平等权益,成为城市管理部门,尤其是民族工作部门的一项函待解决的课题。这就需要有与之相应的理论指导工作,需要调整和完善原有的民族政策,需要制定新的民族政策法规,需要更新和完善城市民族工作的各项机制。在社会主义新时期,做好少数民族流动人口工作,维护好、实现好少数民族流动人口的权益有利于城市的发展与稳定,有利于民族团结和各民族的共同进步,对整个国家都有着重要的现实意义。本文旨在实地调研的基础上,立足于马克思主义民族理论与法学理论,在构建社会主义和谐社会理论指导下,以当前少数民族流动人口面临的现实问题为切入点,通过剖析少数民族流动人口的特点与其流入城市的经济、社会等因素,提出保障少数民族流动人口合法权益的建议,以期在理论服务于现实,理论指导现实的原则下,为民族法学更广泛、更深入地研究现实问题提供一点思路。第一部分:少数民族流动人口的状况分析。主要介绍了少数民族流动人口的现状和特点,以及不同的少数民族人群进入城市的途径,并着重分析了少数民族人口向城市流动的动因。第二部分:少数民族流动人口面临的问题。少数民族流动人口问题的产生是多方面的,诸多因素导致了民族问题的产生。第三部分:解决少数民族流动人口问题的对策与方法。依据前面的分析,结合少数民族和城市的实际情况,提出了相应的解决问题的措施与方法。在研究方法上,本文运用法学、民族学、人类学的相关理论,通过个案研究、多学科综合研究、并采用抽象归纳法、理论联系实际等方法,详细考察我国少数民族流动人口的现状以及面临的问题,以期对少数民族流动人口的权益保障问题进行更为全面、深入的了解,并对那些具有普遍性和规律性的问题进行归纳、提炼和总结,为提出针对性的措施准备理论基础。
[Abstract]:With the deepening of reform and opening up and the development of the socialist market economy, the population of ethnic minorities living in remote and isolated areas began to flow to the east and large and medium-sized cities, and the rapid growth of the floating population of ethnic minorities and between regions. The widespread and frequent behavior of minority population mobility between urban and rural areas has become an important social and economic phenomenon in China. Floating population is one of the most important problems in many traditional disciplines such as sociology, economics, urban science, demography and so on. As the main meeting point of different nationalities and cultures, city is the main initiation area of ethnic relations. How to do well the management and service of the minority floating population and fully guarantee their equal rights and interests has become a subject to be solved by the urban management department, especially the national work department. This requires the corresponding theoretical guidance work, the adjustment and improvement of the original national policies, the need to formulate new national policies and regulations, and the need to update and improve the various mechanisms of urban ethnic work. In the new socialist period, it is beneficial to the development and stability of the city, national unity and the common progress of all ethnic groups to do a good job in the work and maintenance of the floating population of ethnic minorities, and to realize the rights and interests of the floating population of the ethnic minorities. It is of great practical significance to the whole country. On the basis of field investigation, this paper bases on Marxist national theory and legal theory, and under the guidance of constructing socialist harmonious society theory, takes the realistic problems faced by the minority floating population as the breakthrough point. By analyzing the characteristics of minority floating population and the economic and social factors that flow into the city, this paper puts forward some suggestions to protect the legal rights and interests of minority floating population, in the hope of serving the reality in theory and guiding the reality in theory. For the national law more extensive, more in-depth study of practical issues to provide some ideas. The first part: the situation analysis of minority floating population. This paper mainly introduces the present situation and characteristics of the minority floating population and the ways for different minority groups to enter the city, and emphatically analyzes the motivation of the minority population moving to the city. The second part: the problems faced by the minority floating population. The problems of minority floating population come into being in many aspects, and many factors lead to them. The third part: the countermeasures and methods to solve the problem of minority floating population. According to the previous analysis and the actual situation of ethnic minorities and cities, this paper puts forward the corresponding measures and methods to solve the problems. In terms of research methods, this paper uses the relevant theories of law, ethnology, anthropology, case study, multi-disciplinary comprehensive research, and the methods of abstract induction, integrating theory with practice, etc. To investigate in detail the current situation and problems faced by the minority floating population in China, with a view to a more comprehensive and in-depth understanding of the protection of the rights and interests of the minority floating population, and to sum up those problems that are universal and regular. Abstract and summarize, prepare the theoretical foundation for putting forward targeted measures.
