上海市加强新型毒品管理对策研究

【摘要】： 新型毒品是相对鸦片、海洛因、大麻等传统毒品而言的概念,它主要指人工化学合成的致幻剂、兴奋剂类毒品,如冰毒、氯胺酮(K粉)、“摇头丸”等。是由国际禁毒公约和我国法律法规所规定管制的、直接作用于人的中枢神经系统,使人兴奋或抑制,连续使用能使人产生依赖性的精神药品。新型毒品不同于传统毒品,它具有方便、易携带、易服食的特点,更容易被年轻人所接受,因此,发展态势十分迅猛。同时,新型毒品种类繁多,有些精神药物的贩卖和滥用缺乏打击处理依据。法律对新型毒品的惩处相对较轻,司法解释滞后。而且,新型毒品多采取少量的零售方式进行贩卖,也给侦查取证带来了困难。因而毒品违法犯罪分子在利润不减的前提下自然更趋向风险小、相对安全的新型毒品。所以,由于法律法规的滞后,可操作性的司法解释欠缺,和司法机关有效打击的缺乏,导致了新型毒品犯罪的快速上升。上海市作为中国第一大城市,在经济发展的同时,娱乐业也得到了相当的发展,与之相随的就是毒品犯罪的上升。近年来,随着新型毒品的流行,新型毒品犯罪也越来越多见。如闵行区2008年破获的一起案件中就缴获了65395克氯胺酮,为近年来所罕见。加强对新型毒品的治理打击已刻不容缓。本文从毒品管理的三个阶段,即生产加工、运输贩卖、吸食戒断入手,结合近年来禁毒数据,提出当前在对新型毒品管理,首先从易制毒化学品管理着手,通过健全法律,明确易制毒化学品和新型毒品列管范围;针对娱乐场所和互联网两块主要阵地,以打“零包”为主要手段,同时按《禁毒法》的有关规定,强化社区矫治和禁毒宣传,由重缉轻戒转向两头并举,以此来加强对新型毒品的管理。
[Abstract]:New drugs are relative to opium, heroin, cannabis and other traditional drugs, it mainly refers to synthetic hallucinogens, stimulant drugs, such as methamphetamine, ketamine K powder, "ecstasy" and so on. It is regulated by the international drug control convention and the laws and regulations of our country. It acts directly on the central nervous system of human, makes people excited or suppresses, and continuously uses psychotropic drugs which can make people depend on each other. The new drug is different from the traditional drug, it is convenient, easy to carry, easy to eat, more easily accepted by the young people, therefore, the development situation is very swift and violent. At the same time, there are a variety of new types of drugs, some psychotropic substances trafficking and abuse of the lack of anti-treatment basis. The punishment of the new drugs is relatively light and the judicial interpretation lags behind. Moreover, the new drugs are mainly sold in a small amount of retail mode, which makes it difficult to investigate and obtain evidence. Therefore, drug offenders tend to be less risky and relatively safe under the premise of undiminished profits. Therefore, due to the lag of laws and regulations, the lack of operational judicial interpretation, and the lack of effective crackdown by the judiciary, new drug crimes have risen rapidly. Shanghai as the largest city in China, the entertainment industry has also been developed, accompanied by the rise of drug crime. In recent years, with the popularity of new drugs, new drug crimes are more and more common. Minhang District in 2008, such as a case of seizure of 65395 grams of ketamine, rare in recent years. It is urgent to strengthen the control of new drugs. Starting with the three stages of drug management, namely, production and processing, transportation and trafficking, abstinence from smoking, combining with the drug control data in recent years, this paper puts forward that in the current management of new drugs, first of all, we should start with the management of precursor chemicals and adopt sound laws. To clarify the scope of control of precursor chemicals and new types of drugs; and to strengthen community rectification and anti-drug propaganda in accordance with the relevant provisions of the Drug Control Law, aiming at the two main areas of entertainment and the Internet, with "zero packets" as the main means, and in accordance with the relevant provisions of the Drug Control Law, To strengthen the management of new drugs.
