【摘要】：涉网案件已经成为当前刑事案件的主要犯罪形式之一,从最初的计算机犯罪到网络犯罪再到涉网案件犯罪,无论是传统的刑事案件还是新型犯罪,都越来越多的借助网络。最新颁布的《刑事诉讼法》中,将电子数据明确为具有法律效力的8中证据类型之一,这也从侧面说明了涉网案已经成为当前形势下的主要案件类型之一。通过简述网络犯罪的发展历史,以当前我国网络形势的发展为背景,对涉网案件的概念进行了阐述。结合传统刑事案件的特点,对涉网案件的基本特点做了归纳总结,由此引出涉网案件犯罪现场的概念,并根据涉网案件本身的性质特点延伸出涉网案件犯罪现场的特点,再根据不同的案件情况和案件性质,对涉网案件犯罪现场进行分类,在以上论述的基础上,最终给出涉网案件犯罪现场的概念。接着从不同的涉网案件犯罪现场入手,对不同种类的涉网案件特征和线索进行分类、归纳、总结,进一步阐述了涉网案件犯罪现场分析方法的概念。根据侦查实践,对涉网案件的线索进行了分类并通过举例的方式进行了较为详细的阐述,进而总结出不同类型的涉网案件的现场分析方法以及不同环境下的现场分析方法。最后,提出涉网案件犯罪现场分析方法在侦查运用中得到意义以及对于完善学科理论体系的作用。希望通过涉网案件犯罪现场分析方法,能够对公安机关的侦查办案提供理论指导和实际帮助,并对涉网案件侦查理论这一理论体系的完善和补充做出积极的贡献。
[Abstract]:Web-related cases have become one of the main forms of crime in current criminal cases. From the initial computer crime to the network crime and then to the network-related cases, both traditional criminal cases and new crimes are increasingly relying on the network. In the newly promulgated Code of Criminal procedure, the electronic data is defined as one of the eight types of evidence with legal effect, which also shows that the Web-related case has become one of the main types of cases under the current situation. Based on the history of the development of network crime and the development of network situation in our country, this paper expounds the concept of cyber case. Combined with the characteristics of traditional criminal cases, this paper summarizes the basic characteristics of network-related cases, which leads to the concept of crime scene of network-related cases, and extends the characteristics of network-related crime scene according to the nature of network-related cases. Then according to the different cases and the nature of the case, the crime scene of network-related cases is classified. On the basis of the above discussion, the concept of the crime scene of network-related cases is finally given. Then starting with different crime scenes of network-related cases, this paper classifies, induces, summarizes and further expounds the concept of crime scene analysis methods of network-related cases. According to the investigation practice, this paper classifies the clues of the cases involved in the net and expounds them in detail by way of examples, and then sums up the field analysis methods of different types of cases involving the net and the methods of the field analysis under different circumstances. Finally, the paper puts forward the significance of the crime scene analysis method in the investigation and its role in perfecting the discipline theory system. It is hoped that through the method of crime scene analysis, it can provide theoretical guidance and practical help to the investigation and handling of public security organs, and make positive contributions to the perfection and supplement of the theoretical system of investigation of network-related cases.
