高校职务犯罪及其预防探析

【摘要】： 在我国,随着高等教育从精英化向大众化的逐渐普及和高等教育的跨越式发展,特别是高校办学规模不断扩大,教育资金投入越来越多,高校参与经济活动越来越频繁,高校与社会交往越加密切和复杂,基建规模和物资采购数量越来越大,致使各级管理人员的职务犯罪行为呈现扩大化趋势。失衡、错位的高等学校自主权,引发高校管理的职务行为缺失规范和监督,违背了高等学校管理的真实意义和制约了我国高等教育的健康发展。本论文的创新之处在于在法律分析的基础上,找出高校内部管理等方面的不足,力图构建高校职务犯罪预防体系,提出当前职务犯罪预防的对策和新思路。综合运用文献研究法和比较研究法等方法,依据高校职务犯罪基本内涵的廓清,进一步深刻剖析高校职务犯罪产生的客观因素和行为主体的主观原因。通过对中外职务犯罪预防理论的解读,重新审视高校职务犯罪预防的理论、机制、运行模式;同时,从高等学校自主权和高校管理者职务两个角度入手,创新高校职务犯罪预防体系,实现管理者树立法制化治校理念,提升高等学校立法地位,建立教育、制度、监督三者并重的预防体系和预警机制。
[Abstract]:In our country, with the gradual popularization of higher education from elite to popularization and the leap-forward development of higher education, especially the scale of running a university has been expanding, more and more educational funds have been invested, and the participation of colleges and universities in economic activities has become more and more frequent. The relationship between universities and society is more and more close and complicated, the scale of capital construction and the quantity of material purchase are more and more large, which results in the increasing trend of the duty crime behavior of managers at all levels. The imbalance and dislocation of the autonomy of colleges and universities lead to the lack of regulation and supervision of the duties of university management, which violates the true significance of the management of colleges and universities and restricts the healthy development of higher education in China. The innovation of this paper lies in finding out the deficiencies of internal management in colleges and universities on the basis of legal analysis, trying to construct the prevention system of duty crime in colleges and universities, and putting forward the countermeasures and new ideas for the prevention of duty crimes at present. By using the methods of literature research and comparative research, this paper analyzes the objective factors and subjective reasons of the subject of duty crime in colleges and universities according to the clarification of the basic connotation of duty crime in colleges and universities. Through the interpretation of the theory of duty crime prevention at home and abroad, this paper reexamines the theory, mechanism and operation mode of duty crime prevention in colleges and universities, and at the same time, from the perspectives of autonomy of institutions of higher learning and positions of administrators in colleges and universities, Innovating the duty crime prevention system of colleges and universities, realizing the administrators to set up the idea of rule by law, to promote the legislative status of colleges and universities, to establish the prevention system and early warning mechanism of education, system and supervision.
