警察职业院校开设人权法课程的思考

【摘要】: 2004年,“国家尊重和保障人权”载入宪法标志着人权成为我国立国的基本价值取向之一。人权教育的重要性也日益凸现出来。基于大学阶段的人权教育主要以人权法教学为主和警察、法律工作者又是人权教育的主要对象这两个缘由,笔者提出在“警察职业院校开设人权法课程”的命题,通过对警察职业院校开设人权法课程的一般意义的阐述和对笔者所在的某司法警官职业学院学生人权意识和人权价值观情况的实证分析,阐明了在警察职业院校开设人权法的重要性和必要性,提出警察职业院校开设人权法课程的初步构想。 文章的第一部分分析了人权法教学和人权教育的关系,阐明了在警察院校进行人权法教学的意义,指出人权法应作为一门独立的法学课程进行设置,但也需要正视其边缘化的现状。 文章的第二部分通过对笔者所在的某司法警官职业学院学生人权意识和人权价值观情况的问卷调查的实证分析,阐述了警察职业学院有开设人权法课程的现实必要和现实需求。 文章的第三部分是笔者对警察职业院校开设人权法课程的初步构想。在课程目标上,笔者提出人权法教学的目标主要是“塑造人权态度”;在课程内容上安排为人权基本原理和实务两部分,希望学生能够用人权基本原理分析人权热点问题;在课程的时间安排上建议在二年级下期或三年级的上期;在教学方法上应注意处理好理论与知识、意识与信念的关系,强调了互动式教学的重要性和教学过程中现代化的教学工具的使用。
[Abstract]:In 2004, "the state respects and protects human rights" is enshrined in the Constitution, which marks that human rights have become one of the basic values of our country. The importance of human rights education is also increasingly evident. Based on the two reasons that human rights education in university is mainly based on the teaching of human rights law and that the police are the main objects of human rights education, the author puts forward the proposition that "the course of human rights law should be offered in police vocational colleges". Through the elaboration of the general significance of the course of human rights law in the police vocational college and the empirical analysis of the human rights consciousness and human rights values of the students in a judicial police professional college, This paper expounds the importance and necessity of establishing human rights law in police vocational colleges, and puts forward a preliminary conception of the course of human rights law in police vocational colleges. The first part of the article analyzes the relationship between human rights law teaching and human rights education, expounds the significance of human rights law teaching in police academies, and points out that human rights law should be set up as an independent law course. But it also needs to face up to its marginalization. The second part of the article through the author of a judicial police professional college students' human rights awareness and human rights values of the empirical analysis of the situation of the police vocational college to set up the course of human rights law practical necessity and practical needs. The third part of the article is the author of the police vocational colleges to set up a course in human rights law. In terms of curriculum objectives, the author puts forward that the aim of teaching human rights law is mainly to "mold human rights attitude", and to arrange the course contents as two parts: the basic principles of human rights and the practice, hoping that students can use the basic principles of human rights to analyze the hot issues of human rights. In the course schedule, it is suggested that in the second grade or the third grade, attention should be paid to the relationship between theory and knowledge, consciousness and belief in teaching methods. The importance of interactive teaching and the use of modern teaching tools are emphasized.
