邪教犯罪及其侦查方法研究

【摘要】：近些年来,以“奥姆真理教”东京地铁“沙林”毒气事件和“几民圣殿教”900余几集体自杀事件为代表的邪教犯罪活动频繁发生,引起了国际社会的震惊和高度关注。作为一种严重的群体性、宗教性犯罪活动,邪教犯罪由于其组织性高、思想控制严、极端特质强、反政府反社会特性突出,其危害程度远远高于普通刑事犯罪,严重影响政权安全和社会政治稳定,严重侵犯公民的几身和财产权利,成为各国政府十分关心和力图解决的问题,很多学者也投入了大量的心思开展研究工作,在思想认识上和工作方法上取得了很多突破和成果。近年来我国“法轮功”邪教组织活动猖獗,邪教犯罪逐渐成为我国政府和学术界关注和研究的重要课题。随着我国政府在取缔邪教组织、打击邪教犯罪方面工作的不断深入,我们对邪教犯罪的研究和侦查也取得了显著成果,积累了丰富的反邪教经验和研究成果,为邪教犯罪的侦控、处理和防治工作作出了重大贡献。本文主要通过从邪教的介绍、认识和危害入手,探讨和阐述邪教的本质特征,明确邪教的区分和认定,归纳总结了我国邪教犯罪的规律特点和成因,比较了各国反邪教犯罪立法,深入研究了邪教犯罪的侦查方针原则、侦查措施、侦查手段、侦查方式,针对侦查工作中经常使用和出现的卧底侦查、电话监听、零口供与录音录像证据运用等问题提出建设性的见解和意见,力图以笔者的工作实践和理论认识,为我国的邪教犯罪侦查工作贡献微薄的力量。
[Abstract]:In recent years, criminal activities such as the "Om Shinrikyo" Tokyo subway "sarin" gas incident and the "several people's Temple" more than 900 mass suicide incidents have occurred frequently, which has aroused the shock and high attention of the international community. As a serious mass, religious criminal activity, because of its high organization, strict ideological control, strong extreme characteristics, and prominent anti-government anti-social characteristics, cult crime is far more harmful than ordinary criminal crimes. Seriously affecting the security of political power and social and political stability, seriously violating citizens' rights to several bodies and property, has become a problem that governments of various countries are very concerned about and are trying to solve. Many scholars have also devoted a lot of attention to carrying out research work. In the ideological understanding and working methods have made a lot of breakthroughs and achievements. In recent years, the activities of the "Falungong" cult in our country have been rampant, and the crime of the cult has gradually become an important topic that the Chinese government and academic circles have paid close attention to and studied. With the deepening of our government's work in banning cult organizations and cracking down on cult crimes, we have also achieved remarkable results in our research and investigation of cult crimes, and have accumulated rich anti-cult experience and research results. It has made great contributions to the investigation, control, handling, and prevention and control of cult crimes. Starting with the introduction, understanding and harm of cults, this paper probes into and expounds the essential characteristics of cults, clarifies the distinctions and cognizance of cults, and sums up the regular characteristics and causes of the crime of cults in China. By comparing the anti-cult crime legislation of various countries, we have thoroughly studied the investigation policy, principles, investigative measures, investigative techniques, investigation methods, undercover investigation and telephone monitoring, which are often used and appear in the investigation work. This paper puts forward constructive opinions and opinions on the application of zero confession and audio and video evidence in an attempt to contribute a meager strength to the criminal investigation of cults in our country with the author's working practice and theoretical understanding.
