中俄失业人员犯罪之比较研究

【摘要】： 当前,全世界都在经历金融危机的阵痛,失业浪潮席卷全球。伴随高失业率而来的负面影响很多,笔者通过调查获得一些与失业人员犯罪有关的数据及资料,通过本文对中俄失业人员犯罪的现象进行比较和探究。中俄失业人员犯罪的类型既有相同也有不同,相同点在于为生活所逼的侵犯财产类案件较多;失业人员相互勾结的团伙作案较多;以男性为主的轻微故意犯罪较多;近几年随着社会生活的变化一些新型的犯罪出现了。两者的区别在于中俄有组织犯罪的不同。失业人员犯罪的社会原因在于生存目标与谋生手段的冲突,此种冲突使得犯罪成为一些失业人员的有效谋生方式。失业人员犯罪的个体原因在于生理和心理方面。要对症下药的防控失业人员犯罪,笔者认为可以从宏观和微观两个不同层面对此进行综合防治,并以宏观防治为主。宏观层面的防治指对失业人员生存目标与谋生手段的冲突进行化解,具体包括社会财富的再分配、促进就业工程、建立失业预警机制和加强社会保障机制等多个方面;微观层面的防治指对失业人员个体进行有效的社会防控,具体包括加强社区帮助和失业人员心理疏导等几个方面。
[Abstract]:At present, the world is experiencing the pain of the financial crisis, unemployment wave swept the world. There are many negative effects associated with the high unemployment rate. The author obtains some data and information related to the crime of the unemployed through the investigation. Through the comparison and exploration of the phenomenon of the crime of unemployed persons in China and Russia, the types of crimes committed by unemployed persons in China and Russia are not only the same but also different, the similarities lie in the fact that there are more cases of infringing on property forced by life; The gang that the unemployed person colludes with each other commit more crimes; the minor and intentional crime mainly with the male is more; in recent years with the change of social life some new type of crime has appeared. The difference between the two lies in the difference between Chinese and Russian organized crime. The social reason of the crime of the unemployed lies in the conflict between the survival goal and the means of livelihood, which makes the crime become an effective way for some unemployed people to earn a living. The individual cause of the crime of the unemployed lies in the physical and psychological aspects. In order to prevent and control the crime of unemployed persons, the author thinks that it can be comprehensively prevented and controlled from two different levels of macro and micro, and the main prevention and cure is macro. The macro-level prevention and cure refers to resolving the conflict between the survival goal and the means of livelihood of the unemployed, including the redistribution of social wealth, the promotion of employment project, the establishment of the early warning mechanism of unemployment and the strengthening of the social security mechanism. Microcosmic prevention and control refers to the effective social prevention and control of the unemployed individual, including the strengthening of community help and psychological guidance of the unemployed.
