基层交警执法难现状及对策研究

【摘要】： 伴随国民经济和交通事业的快速发展,交通管理尤其是交通执法问题逐渐成为一个社会热点。在过去的几年中,各地公安交警部门结合实际、讲求实效,认真贯彻党中央和公安部的各项方针政策,在保障交通安全、畅通和维护社会稳定中取得可喜成绩的同时,自身也在不断发展壮大。对于公安交警部门而言,基层交警是服务群众的前台,是整个交通执法工作的根基,也是推动交通管理事业长远发展的基石,同时基层交警还是维护社会秩序的中坚力量,其执法水平的高低和执法效果的好坏直接关系到经济社会的发展和人民生活水平的提高,然而近年来,基层交警在执法过程中,却产生了来自各方面的困难,其中有基层交警部门和警员自身的困难,也有行政管理体制带来的不便,更重要的表现是屡屡遭到交通违法者不同程度的抗拒、阻挠甚至暴力袭击,不但严重扰乱了公安交警部门正常的执法活动,破坏了人民警察的执法权威,侵害了交通民警的人身权利,同时也严重挫伤了基层交警对执法工作的积极性。造成这一困境的原因是多方面的,既有基层交警队伍执法主体素质的缺陷,又有执法环境的复杂；既有保障机制的缺位,又有执法监督的不足。在此情况下,关注基层交警执法的现状,总结国内先进经验,借鉴国外优秀做法,从队伍建设、执法环境、保障机制、执法监督各方面入手破解我国基层交警执法难题,对于创建安全畅通的交通秩序,更好地为经济发展和群众生活保驾护航具有重要的现实意义。
[Abstract]:With the rapid development of national economy and transportation industry, traffic management, especially traffic law enforcement, has gradually become a social hot spot. In the past few years, local public security and traffic police departments have combined the actual situation, stressed practical results, conscientiously implemented the various principles and policies of the party Central Committee and the Ministry of Public Security, and made gratifying achievements in ensuring traffic safety, smooth running and maintaining social stability. They are also growing. For public security traffic police departments, the grassroots traffic police are the front desk for serving the masses, the foundation for the entire traffic law enforcement work, and the cornerstone for promoting the long-term development of traffic management. At the same time, the grass-roots traffic police are also the backbone forces in maintaining social order. The level of law enforcement and the effect of law enforcement are directly related to the development of economy and society and the improvement of people's living standard. However, in recent years, the grass roots traffic police have had difficulties from various aspects in the process of enforcing the law. Among them are the difficulties of the grass-roots traffic police departments and police officers themselves, as well as the inconvenience caused by the administrative system. What is more important is that they are repeatedly resisted, obstructed or even violently attacked by traffic lawbreakers to varying degrees. It not only seriously disturbs the normal law enforcement activities of the public security traffic police department, destroys the law enforcement authority of the people's police, infringes on the personal rights of the traffic police, but also seriously dampens the enthusiasm of the traffic police at the grass-roots level for the law enforcement work. There are many reasons for this dilemma, both the defects of the law enforcement subject quality of the grass roots traffic police team and the complexity of the law enforcement environment, as well as the absence of the safeguard mechanism and the insufficiency of the law enforcement supervision. In this case, we should pay attention to the current situation of traffic police law enforcement at the grass-roots level, sum up the domestic advanced experience, draw lessons from foreign excellent practices, and solve the problems of law enforcement at the grass-roots level in our country from the aspects of team building, law enforcement environment, protection mechanism and law enforcement supervision. It is of great practical significance to establish safe and smooth traffic order and to better protect the economic development and the life of the masses.
