流动人口犯罪发生机制研究

【摘要】： 随着我国经济的发展,人口的流动成为必然。大量的流动人口进入城市,成为城市发展的生力军。同时,他们的出现也为城市带来了一个严重的社会问题——犯罪率上升。如何解决这个问题成为众多学者专家的研究课题。笔者从流动人口犯罪发生机制入手,找出解决流动人口犯罪频发的根源所在,以期能够为制订预防流动人口犯罪的对策提供一些建议。对流动人口犯罪发生机制进行专门的研究,就是要揭示流动人口这一特殊主体的犯罪行为发生过程,各致罪因素之间的律动作用联系。具体而言,研究这个机制就是要探明流动人口为什么会犯罪犯罪行为又是如何产生的等问题。本文首先从湖南省湘潭市某区2007年至2009年10月将近三年中所审结的流动人口刑事案件入手,分析流动人口犯罪现状及犯罪的主要特征。从这些特征中,笔者得出流动人口犯罪的致罪因素主要有:经济政策失误、社会控制弱化、被害人处于弱势的环境条件、潜在犯罪意识以及个人行为失范。这些致罪因素在犯罪发生的整个过程中的律动作用联系,便是笔者所要探讨的流动人口犯罪发生机制。在这个致罪机制中,各致罪因素相辅相成,或此消彼长,或互为表里,促使流动人口犯罪意识产生,再转化为犯罪决意,最后实施犯罪行为。在这个致罪机制中,笔者也得出了一些预防流动人口犯罪的对策性建议:优化宏观社会环境,抑制犯罪意识产生,把犯罪扼杀在第一个阶段;完善微观社会环境,扼制犯罪决意形成,使犯罪意识无法转化为犯罪行为;加强流动人口管理,消除流动人口犯罪行为实施的条件。当然,要预防流动人口犯罪,不是一蹴而就的,需要社会更多的关怀,更要注重对流动人口合法权益的保护。
[Abstract]:With the economic development of our country, the flow of population becomes inevitable. A large number of floating population into the city, become the new force of urban development. At the same time, their appearance for the city also brought a serious social problem-rising crime rate. How to solve this problem has become a research topic for many scholars and experts. Starting with the mechanism of floating population crime, the author tries to find out the root cause of the frequent occurrence of floating population crime, in the hope of providing some suggestions for the formulation of countermeasures to prevent floating population crime. The special research on the mechanism of crime of floating population is to reveal the relation of rhythmic action between the factors of crime and the process of criminal behavior of floating population as a special subject. Specifically, the study of this mechanism is to find out why and how the floating population criminal behavior. This paper begins with the criminal cases of floating population in a district of Xiangtan City Hunan Province from 2007 to October 2009 and analyzes the present situation of the crimes committed by the floating population and the main characteristics of the crimes. From these characteristics, the author concludes that the main factors causing the crime of floating population are: economic policy failure, weakening of social control, victims in the weak environmental conditions, potential crime awareness and individual misconduct. The relation of these factors in the whole process of crime is the mechanism of floating population crime. In this mechanism, the factors of crime supplement each other, or rise and fall, or in each other, promote the floating population to produce a sense of crime, and then transform into a criminal decision, and finally carry out criminal behavior. In this mechanism of crime, the author has also come up with some countermeasures to prevent the crime of floating population: optimizing the macro social environment, restraining the emergence of the crime consciousness, killing the crime in the first stage, perfecting the micro social environment, In order to control the formation of crime determination, the consciousness of crime cannot be transformed into criminal behavior, and the management of floating population should be strengthened to eliminate the conditions for the implementation of criminal behavior of floating population. Of course, to prevent the floating population crime, not overnight, need more social care, pay more attention to the protection of the legitimate rights and interests of the floating population.
