增城区公安分局“刑事速裁”政策执行问题与对策研究

【摘要】：2014年6月27日,十二届全国人大常委会第九次会议通过了《关于授权最高人民法院、最高人民检察院在部分地区开展刑事案件速裁程序的试点工作的决定》(以下简称《决定》),在北京、天津、上海、广州和深圳等18个案件基数大、类型多且具有典型性、代表性的地区开展刑事案件速裁程序试点工作。该《决定》被看作是开创了刑事诉讼试验性立法的先河。广州市公安局发布《广州市公安局刑事案件速裁程序试点工作实施方案》,意味着刑事案件速裁程序试点工作从2014年8月正式拉开帷幕。刑事案件速裁程序旨在解决司法资源紧缺与刑事案件数量骤增之间的矛盾,对刑事案件建立一套繁简有别的诉讼程序,依法从快从简办理轻微刑事案件。公安机关侦查工作作为刑事诉讼的首要环节,启动该程序能够有效提高诉讼效率、优化司法资源配置,该程序执行工作的成效事关重大,对促进我国司法改革有着重要的意义。本文对增城区公安分局试点“刑事速裁”政策执行情况开展研究,笔者作为公安机关人员,能够迅速掌握试点工作的第一手资料,充分认识该政策执行的现状,采用问卷调查法、访谈法和文献研究法三种方法,以史密斯政策执行模型为理论导向,从理想化的政策、执行主体、目标群体和环境因素四个方面,对增城区公安分局试点“刑事速裁”政策执行状况进行了探讨,发现执行中遇到的困难,深度挖掘原因,并得出有利于该政策执行的对策与建议,从全新的理论角度出发,为下一步全面推广“刑事速裁”政策执行扎实了理论基础与实践参考。
[Abstract]:On June 27, 2014, the Ninth meeting of the standing Committee of the Twelfth National people's Congress adopted the draft on authorizing the Supreme people's Court, The decision of the Supreme people's Procuratorate to launch the pilot work of the criminal case adjudication procedure in some regions. "(hereinafter referred to as" the decision "), 18 cases in Beijing, Tianjin, Shanghai, Guangzhou and Shenzhen have a large base number, many types and are typical. The representative regions will carry out the trial work of the criminal case adjudication procedure. The decision is seen as a pioneer in the experimental legislation of criminal procedure. Guangzhou Public Security Bureau issued the "trial program of criminal cases quick adjudication procedure of Guangzhou Public Security Bureau", which meant that the trial work of criminal cases quick adjudication procedure began formally in August 2014. The criminal case adjudication procedure aims to solve the contradiction between the shortage of judicial resources and the sudden increase in the number of criminal cases, and sets up a set of complex criminal cases with other procedural procedures to deal with minor criminal cases as soon as possible according to law. The investigation of public security organs is the most important link in criminal procedure. Starting this procedure can effectively improve the efficiency of litigation and optimize the allocation of judicial resources. The effectiveness of the implementation of this procedure is of great importance, and it is of great significance to promote the judicial reform in our country. This article carries on the research to the Zengcheng District Public Security Bureau pilot "criminal quick adjudication" policy implementation situation, the author, as the public security organ personnel, can quickly grasp the pilot work first-hand information, fully understands this policy implementation present situation, Using three methods: questionnaire survey, interview and literature research, taking Smith's policy execution model as the theoretical guidance, from four aspects of idealized policy, executive subject, target group and environmental factors, This paper probes into the implementation of the policy of "criminal quick adjudication" in Zengcheng District Public Security Substation, finds out the difficulties encountered in the implementation of the policy, deeply excavates the reasons, and draws the countermeasures and suggestions conducive to the implementation of the policy, starting from a completely new theoretical point of view. It provides a solid theoretical basis and practical reference for the implementation of the "criminal quick adjudication" policy.
