论我国高校职务犯罪之防控

【摘要】: 高等院校是传播先进文化和从事科学研究的前沿阵地,是培养社会主义事业建设者和接班人的重要基地。改革开放30多年以来,在党和国家的高度重视下,高校呈现出蓬勃发展的良好势头。然而,在高校发展浪潮高涨的同时,一个难以根除的毒瘤——高校职务犯罪也历经了从无到有、并迅速膨胀的过程。而今,高校频传职务犯罪丑闻,一则则案例直叫人触目惊心,人们心中圣洁的“象牙塔”形象已经轰然倒地。高校职务犯罪防控已经成为摆在国家、社会及高校自身面前的一个刻不容缓的问题。 对于任何一种犯罪现象,从其出现时我们的手足无措到能够以成熟、完善的体系来加以防控,这中间必然是一个长期跋涉的过程。在这个过程中,如何破解高校运行管理中遇到的难题,综合运用教育、行政、法律等手段有效预防违法违纪案件的发生,确保高等教育事业健康、可持续发展,是一个亟待解决的现实问题。 本文除导言和结语外,主体共分为四个部分。 第一章是高校职务犯罪防控概述。首先,该部分通过对职务犯罪的界定引出了高校职务犯罪的概念及高校职务犯罪防控的概念,指出高校职务犯罪防控是指具有高校职务犯罪防控职责的各主体为维护国家政权和高校教学秩序,通过整合国家、社会和高校的各项职能,规范和制约高校公职人员的职务行为,对高校职务犯罪所实施的系统性控制。此外,该部分还对高校职务犯罪的演化阶段、高校职务犯罪的现状及危害作了较为详细的论述,从而指出通过体系构建对高校职务犯罪进行系统性防控是一个迫在眉睫的举措。 第二章分析了高校职务犯罪发生的原因。任何事物的变化发展都是内因和外因共同作用的结果。对高校职务犯罪主观因素的分析,主要从错误的价值观念及变异的心理因素两个方面进行,指出灰暗消极的世界观、自私自利的人生观、随心所欲的职业道德观、淡薄虚无的法纪观,以及吃亏补偿心理、投资回报心理、法不责众心理、侥幸逃脱心理是引发高校职务犯罪的主要主观因素。接着阐述了高校职务犯罪发生的客观原因,主要包括经济体制转轨时期的消极影响、高校行政化机制的负面效应、高校管理制度的缺陷、监督措施的缺位及法纪教育的乏力等。对引发高校职务犯罪的原因所进行的全面分析,是构建高校职务犯罪防控体系的必要前提。 在对高校职务犯罪进行了全面认识、对高校职务犯罪原因进行了深刻分析的基础之上,第三章提出了高校职务犯罪防控体系的全面构建。为了使读者认同高校职务犯罪防控具有坚实的理论基础及现实可行性,该部分首先阐述了高校职务犯罪具可控性的理论及现实基础。接着,水到渠成地构建了一个以“教育——管理——监督”为主线的防控体系,其具体内容包括:高校廉政文化建设、高校管理体制建设、高校管理制度建设、法律制度建设及高校监督体制建设。
[Abstract]:Institutions of higher learning are the frontiers for spreading advanced culture and engaging in scientific research, and are the important bases for cultivating builders and successors of socialist undertakings.Since the reform and opening-up 30 years ago, with the great attention of the Party and the state, universities have shown a good momentum of vigorous development. Nowadays, there are many scandals of job-related crimes in Colleges and universities, one case is shocking, and the image of the Holy "ivory tower" in people's hearts has fallen to the ground. An urgent matter.
It is a long-term process for us to prevent and control any kind of criminal phenomena from being helpless when they appear to be able to use a mature and perfect system. In this process, how to solve the difficult problems encountered in the operation and management of colleges and universities, and how to effectively prevent violations of laws and discipline by means of education, administration and law, etc. It is a realistic problem to be solved urgently to ensure the healthy and sustainable development of higher education.
In addition to the introduction and conclusion, the main body is divided into four parts.
The first chapter is an overview of the prevention and control of job-related crimes in Colleges and universities.Firstly, this part introduces the concept of job-related crimes in Colleges and universities and the concept of prevention and control of job-related crimes in Colleges and universities through the definition of job-related crimes. In addition, this part also discusses in detail the evolution stage, the present situation and the harm of the university's duty crime, and points out that the university's duty crime can be controlled by the system construction. Systematic prevention and control of job-related crimes is an imminent move.
The second chapter analyzes the causes of job-related crimes in Colleges and universities.Everything changes and develops as a result of both internal and external factors.The analysis of subjective factors of job-related crimes in Colleges and universities is mainly carried out from two aspects of wrong values and psychological factors of variation.It points out that gloomy and negative world outlook and selfish outlook on life follow. The main subjective factors that lead to job-related crimes in Colleges and universities are the voluntary professional ethics, the weak and nihilistic concept of law, the psychology of compensation for losses, the psychology of return on investment, the psychology of not being responsible for the masses by law and the psychology of escaping by fluke. The negative effects of politicization mechanism, the defects of university management system, the absence of supervision measures and the lack of legal education, etc. A comprehensive analysis of the causes of University job-related crimes is a necessary prerequisite for the construction of the prevention and control system of University job-related crimes.
On the basis of a comprehensive understanding of job-related crimes in Colleges and universities and a profound analysis of the causes of job-related crimes in Colleges and universities, the third chapter puts forward a comprehensive construction of the prevention and control system of job-related crimes in Colleges and universities. Secondly, a preventive and control system with education-management-supervision as the main line has been constructed, which includes the construction of honest and clean government culture, management system, management system, law system and supervision system.
