社区服务令在未成年人罪犯社区矫正中的适用研究

【摘要】：在别的国家，又将社区服务令称为社区劳役、公益劳动等等，采用这种方法，犯罪人可以通过在社区中提供固定时间的无偿劳动来避免其他刑事惩罚。通过社区服务令，我们可以采用新的方式来惩罚改造犯罪人。其具有三大特点，即恢复性、社会化以及宽严相济，其主要实施对象为未成年人罪犯。这些犯罪人往往缺乏成熟的心智以及认知等等，因此在惩罚方式上要和成年犯罪人有所区别，加之这些犯罪人通常对社会没有较大的危险性，因此可以使用社区服务令来作为刑事犯罪处理方式。通过刑事犯罪处理方式最终目的是感化以及教育这些犯罪人，因此社区服务令更加符合这一思想。在我国第八次刑法修正案中，社区矫正正式别列为未成年人刑事犯罪处理方式，在这种情况下，本文主要就社区服务令的适用性进行了全面的分析。本文主要的主要内容有： 第一部分介绍了本文的研究背景，并提出研究的问题。第二部分阐述了社区服务令的相关概念，首先界定了社区服务令的内涵，然后分析了社区服务令的特征和本质，最后梳理了社区服务令的发展历程。第三部分探讨了社区服务令在未成年罪犯中的适用价值，，主要包括四个方面：社区服务令有利于提高未成年罪犯的改造质量，有利于刑法人道化的推进，有利于正确教育未成年罪犯，有利于未成年罪犯回归社会。社区服务令在未成年罪犯中的具体实施，主要介绍了社区服务令的内容，社区服务令的实施过程，对实施的效果进行评价。最后一部分是全文的总结。
[Abstract]:In other countries, community service order is also called community servitude, public service and so on. By using this method, the offender can avoid other criminal punishment by providing unpaid work for a fixed period in the community. Through community service orders, we can punish offenders in new ways. It has three characteristics, namely, recovery, socialization and leniency. These criminals often lack the maturity of mind and cognition and so on, so they should be punished differently from adult offenders, and these criminals are usually not more dangerous to society. Community service orders can therefore be used as a way of dealing with criminal offences. The ultimate purpose of criminalizing and educating these offenders is to make community service more consistent with this idea. In the eighth Criminal Law Amendment of our country, community correction is formally classified as a minor criminal treatment. In this case, this paper mainly analyzes the applicability of community service order. The main contents of this paper are as follows: the first part introduces the research background and puts forward the research questions. The second part expounds the related concepts of community service order, first defines the connotation of community service order, then analyzes the characteristics and essence of community service order, finally combs the development of community service order. The third part discusses the applicable value of community service order in juvenile offenders, mainly including four aspects: community service order is conducive to improve the quality of minor offenders reform, is conducive to the promotion of humanization of criminal law. It is conducive to the correct education of juvenile criminals and the return of juvenile criminals to society. This paper mainly introduces the content of community service order, the implementation process of community service order, and evaluates the effect of implementation. The last part is the summary of the full text.
