构建“少年社区矫正”的独立话语权——以整合现有资源角度为出发点

【摘要】：在独立的少年司法制度与行刑社会化理念不断被强调的现如今,相关改革虽不得一蹴而就,但充分利用现有司法资源及社会资源,以刑事执行领域中的"少年社区矫正制度"为切入点来探讨相关制度的构建不失为改革进程中一条更为适宜的进路。本文从整合现有资源的角度出发来讨论少年社区矫正制度,指出问题所在并提出若干合理构想,试为相关制度的完善建言。
[Abstract]:With the independent juvenile justice system and the concept of socialization of execution being constantly emphasized, although the relevant reform cannot be accomplished overnight, the existing judicial and social resources are fully utilized. Taking the juvenile community correction system in the field of criminal execution as the starting point to explore the construction of the relevant system is a more appropriate way in the reform process. This paper discusses the system of juvenile community correction from the angle of integrating the existing resources, points out the problems and puts forward some reasonable ideas, and tries to make suggestions for the perfection of the relevant system.
