当前暴力犯罪现状、成因与对策研究

【摘要】： 力犯罪作为一类严重危害人身权利与财产权利的犯罪行为类型,在我国刑法理论与司法实务中都具有重要的研究价值。如何真正的理解暴力犯罪,透彻的分析并把握暴力犯罪的成因,并采取适合我国实际国情,切实的达到控制暴力犯罪发案率的对策,是关系到我国社会主义现代化与当前和谐社会建设能否顺利进行的重要课题。本文主要从三个方面对暴力犯罪展开研究,即暴力犯罪的现状、成因与对策研究。文章第一部分首先从犯罪学与刑法学两个角度对暴力犯罪的概念进行阐述,进而概括出暴力犯罪的本质特征,为接下来的现状归纳、原因分析与对策探析奠定理论基础。通过对暴力犯罪基本理论的研究,暴力犯罪作为一类重要的犯罪行为类型,对其成因与对策的研究应采取广义的理解,即暴力犯罪指行为人使用暴力或以暴力相威胁,非法侵犯他人人身或财产的犯罪行为。接下来介绍了当前暴力犯罪的现状,选取了四个比较突出的特点展开论述。文章第二部分针对当前暴力犯罪的现状与特点,分析了当前我国暴力犯罪发生的原因。从市场经济、社会转型、就业压力、腐败现象、情感问题、法制教育、暴力文化七个角度对当前暴力犯罪发生的原因进行里较为详细的阐述。第三部分是当前暴力犯罪的对策研究。暴力犯罪的对策应以预防为主,只有把预防工作做好,才是遏制暴力的治本之策。在做好暴力犯罪的预防工作的基础上附之以必要的打击,这样才能实现标本兼治,达到最好的治理成果。文章从打防结合、打击对策与预防对策三个方面提出了当前暴力犯罪的具体对策,试图找到适合我国实际切实可行的遏制暴力犯罪发生的有效对策。
[Abstract]:As a kind of criminal behavior which seriously endangers the right of person and property, the crime of force crime has important research value in the theory of criminal law and judicial practice in our country. How to truly understand violent crime, thoroughly analyze and grasp the causes of violent crime, and take measures to control the incidence of violent crime, which are suitable for the actual situation of our country, It is an important subject related to the construction of socialist modernization and harmonious society. This paper mainly studies the violent crime from three aspects, namely, the present situation of violent crime, the cause of formation and the countermeasure research. The first part of the article expounds the concept of violent crime from two angles of criminology and criminal law, and then generalizes the essential characteristics of violent crime, which lays a theoretical foundation for the following current situation induction, cause analysis and countermeasure analysis. Through the study of the basic theory of violent crime, as an important type of criminal behavior, violent crime should be understood in a broad sense, that is, violent crime refers to the perpetrator's use of violence or threat of violence. An unlawful act against the person or property of another person. Then introduced the current situation of violent crime, selected four more prominent characteristics to discuss. In the second part, according to the current situation and characteristics of violent crime, the causes of violent crime in China are analyzed. From the aspects of market economy, social transformation, employment pressure, corruption, emotional problems, legal education and culture of violence, the causes of current violent crimes are elaborated in detail. The third part is the countermeasure research of current violent crime. The countermeasures of violent crime should focus on prevention, only to do a good job of prevention, is to curb the root cause of violence. On the basis of the prevention of violent crime, it is necessary to deal a blow, so as to achieve both the symptoms and the root causes and achieve the best results. This paper puts forward the concrete countermeasures of the current violent crime from three aspects of the combination of attack and prevention, the countermeasures of striking and preventing, and tries to find out the effective countermeasures which are suitable for the actual situation of our country to contain the occurrence of violent crime.
