公安机关政府采购法律问题研究

【摘要】：政府采购是现代政府为履行其公共职能所形成的专门性制度,政府采购具有复杂的法律性质：其既具有民事法律属性也具有行政法律属性,同时政府采购又涉及政府、供应商以及社会公共利益等多方主体。公安机关政府采购是我国政府采购体系的重要组成部分,其相对于其他类型的政府采购更加具有重要性与特殊性。本文从政府采购的一般问题出发,明确政府采购的概念特征,然后系统考察了我国公安采购的现状,发掘了政府采购中在立法、运行、监督、责任上存在的问题,并详尽地分析了产生问题的成因,从而在此基础上提出完善我国公安采购的可行性对策。第一部分,公安机关政府采购概述,是本研究的逻辑起点,阐述了公安采购中的基础性问题,包括公安采购的概念、公安采购的特征、意义等问题,从而对公安采购的整体面貌做出了详细展现,为后面的研究提供了理论基础。第二部分,我国公安采购法律问题的现状及问题,是本文研究的主要内容。首先,阐述了我国公安采购的整体概况及现状,展示了我国公安采购所取得的成绩；其次,检讨了我国公安采购所存在的问题及其表现,指出公安采购在立法、具体程序、监督机制与责任设置上均存在一定的问题；再次,深入分析了公安采购问题所产生的原因,从而为解决问题提供了思路。第三部分,我国公安机关政府采购法律问题的完善对策,是本文的落脚点。从立法完善、程序完善、监督完善、责任完善等四个角度详细地研究了公安采购的完善对策,从而为解决问题提供了具体可行的思路,从而彰显研究的实践价值。
[Abstract]:Government procurement is a specialized system formed by the modern government to perform its public functions. Government procurement has a complex legal nature: it has both civil legal attributes and administrative legal attributes, and government procurement involves the government at the same time. Suppliers and public interests and other parties. Public security organ government procurement is an important part of our government procurement system, which is more important and special than other types of government procurement. Starting from the general problems of government procurement, this paper clarifies the conceptual characteristics of government procurement, then systematically examines the present situation of public security procurement in China, and explores the problems existing in legislation, operation, supervision and responsibility in government procurement. Based on the detailed analysis of the causes of the problems, the feasible countermeasures to perfect the public security procurement in China are put forward. The first part, the overview of public security organs' government procurement, is the logical starting point of this study. It expounds the basic problems in public security procurement, including the concept of public security procurement, the characteristics and significance of public security procurement, etc. Thus the overall appearance of public security procurement made a detailed display, for the following research provides a theoretical basis. In the second part, the current situation and problems of public security procurement in China are the main contents of this paper. First of all, it expounds the general situation and present situation of public security procurement in our country, and shows the achievements of public security procurement in our country. Secondly, the paper reviews the problems and performance of public security procurement in China, and points out that there are some problems in the legislation, concrete procedure, supervision mechanism and responsibility setting of public security procurement. Thirdly, the paper analyzes the causes of public security procurement problem, and provides ideas for solving the problem. The third part, our country public security organ government procurement legal question consummation countermeasure, is this article's foothold. From the four angles of perfect legislation, perfect procedure, perfect supervision and perfect responsibility, this paper studies in detail the perfect countermeasure of public security procurement, which provides a concrete and feasible way of thinking for solving the problem, thus showing the practical value of the research.
