社区矫正检察监督实证研究

【摘要】：社区矫正已在全国范围内进入试行阶段,作为一种刑罚执行活动,它预示着我国刑罚制度由重刑主义向轻刑主义演化,由普遍监禁刑向普遍非监禁刑的发展,受到实务界和学界大力推崇,但随着社区矫正试点的深入与发展,这种行刑方式亦存在许多问题和不完善之处。作为法律监督机关的检察院,如何发挥和改进监督职能,使社区矫正工作达到预期的矫正效果,是目前值得探讨的一个重要课题。 笔者以浙江省平阳县的社区矫正检察监督工作开展情况为基点,通过收集规章制度,查阅、提取相关数据和资料,实地走访司法行政机关、个别基层司法所,访谈部分监所检察人员、社区矫正工作人员、社区矫正对象等方式,进行了调研,归纳总结了当前我国社区矫正检察监督工作的现状,重点对检察监督工作存在的问题及原因进行分析,并提出完善对策及建议。 论文主体分为四部分:第一部分是对社区矫正的概念、价值进行评析,对社区矫正检察监督的概念、特征及实施的必要性进行阐述,为下步的调研打下理论基础;第二部分以浙江省平阳县社区矫正检察监督情况为实际考证对象,通过对检察机关参与社区矫正工作的机构设置、人员配备、信息化建设、监督手段的使用、具体工作开展情况的介绍、民意调查的反馈等,介绍了社区矫正检察监督考察情况;第三部分得出调研结论,并重点指出当前社区矫正检察监督工作中存在的问题,主要有:监督内容不完整、对象不明确、强制力不足、工作过于被动、文书送达缺乏统一规范、立法的缺陷、人权保障监督不力、机构设置和人事配备不合理等。同时对上述问题进行原因分析,主要有:检察监督立法和社区矫正制度的不完善、监督理念的偏差、社区矫正对象法律知识的欠缺等等;第四部分运用综合分析法,从完善社区矫正及检察监督制度、优化监督方式、合理设置机构、加强队伍建设、加强法制宣传和教育等角度提出完善的对策及建议。
[Abstract]:Community correction has entered the trial stage in the whole country, as a kind of penalty execution activity, it indicates the development of our country's penalty system from heavy punishment to light punishment, from universal imprisonment to universal non-imprisonment. It is highly praised by the practical and academic circles, but with the deepening and development of the community correction pilot, there are many problems and imperfections in this execution method. As the procuratorate of the legal supervision organ, how to exert and improve the supervision function and make the community correction work achieve the expected correction effect is an important subject worth discussing at present. Based on the work of community correction procuratorial supervision in Pingyang County, Zhejiang Province, the author collected rules and regulations, consulted, extracted relevant data and materials, and visited judicial administrative organs and individual grass-roots judicial offices on the spot. Interview some procuratorial staff, community correction objects, etc., and summarize the current situation of the procuratorial supervision of community correction in our country. The problems and causes of procuratorial supervision are analyzed, and the countermeasures and suggestions are put forward. The main body of the paper is divided into four parts: the first part is to evaluate the concept of community correction, the value of community correction, the concept, characteristics and implementation of the necessity of community correction procuratorial supervision to lay a theoretical foundation for the next step of research; The second part takes the situation of procuratorial supervision of community correction in Pingyang County of Zhejiang Province as the actual object of textual research, through setting up, staffing, information construction and the use of supervision means of procuratorial organs participating in community correction work. The introduction of the specific work, the feedback of the public opinion survey, etc., introduced the inspection situation of the procuratorial supervision of community correction; The third part draws the research conclusion, and points out the existing problems in the current community correction procuratorial supervision work, mainly includes: the supervision content is not complete, the object is not clear, the compulsive force is insufficient, the work is too passive, the document service lacks the unified standard. The defects of legislation, inadequate supervision of human rights protection, unreasonable establishment of institutions and personnel, etc. At the same time, the causes of the above problems are analyzed, including: the imperfect procuratorial supervision legislation and community correction system, the deviation of the supervision idea, the lack of legal knowledge of the community correction object and so on; The fourth part uses the comprehensive analysis method, from the consummation community correction and the procuratorial supervision system, optimizes the supervision way, reasonably sets up the organization, strengthens the troop construction, strengthens the legal system propaganda and the education and so on angle consummates the countermeasure and the suggestion.
