彝族传统法文化对四川彝区社区矫正的影响与对策研究

【摘要】：彝族传统法文化与社区矫正在回归社会、和谐包容、多方参与等方面存在契合,尤其是家支头人和德古的参与,有利于实现矫正队伍的多元化。但血缘家支、习惯法、德古对社区矫正也存在消极影响,为此,要构建彝族地区社区矫正之有效路径,让社区矫正能在彝族社会被广泛实施和接受,就必须重视家支制度力量,注重习惯法与国家法的调适,善于利用德古的权威性,并参照彝族习惯法创新对矫正对象的处置方法。
[Abstract]:The traditional law culture of Yi nationality and the community correction are in harmony with each other in the aspects of returning to society, harmony and tolerance, participation of many parties, especially the participation of family leaders and de Gu, which is beneficial to the realization of the diversification of correction team. However, consanguinity, customary law and de Gu also have negative effects on community correction. Therefore, in order to construct an effective path of community correction in Yi nationality areas and enable community correction to be widely implemented and accepted in Yi society, it is necessary to attach importance to the power of family support system. It pays attention to the adjustment of customary law and national law, makes good use of the authoritativeness of Degu, and innovates the method of dealing with the object of correction with reference to the customary law of Yi nationality.
