青少年网络违法犯罪的政府治理问题研究

【摘要】： 随着计算机和网络技术的普及与发展,网络的触角已涉及到了人类社会的各个领域,网络在给我们带来许多便利的同时,也引发了诸多的问题。青少年网络违法犯罪是随着网络的产生、发展而新出现的一种违法犯罪类型。不仅其发案率逐年增加,蔓延迅速,而且破坏力大,社会危害十分严重。本文在考察国内外网络犯罪状况和治理网络犯罪对策的基础上,并从政府治理的角度,对政府治理青少年网络违法犯罪的相关问题作一探讨,提出政府通过完善行政制度调控、强化政府行政监管责任、引导优化网络教育环境、推动互联网行业自律、重视社会监督等应对措施,在治理中发挥核心、主导作用等的具体防治对策。本文主要包括三部分内容: 首先,阐述了青少年网络犯罪及其政府治理的基本理论。青少年网络违法犯罪的概念及主要特征、表现形式及存在原因。该部分从青少年网络犯罪的概念着手,结合自己的理解,总结青少年网络犯罪的特征,并结合实际分析出青少年网络犯罪的成因。同时阐述了政府治理的概念、治理特点及必要性。其次,分析了我国青少年网络违法犯罪的治理状况。该部分介绍了对我国治理网络违法犯罪的现状考察,总结出我国治理现状及存在的网络立法不健全、政府网络监管不力、政府行政职能越位、对多元化主体的政策指导不到位、引导行业自律效果不明显等问题,为下一步提出我国政府治理网络违法犯罪的对策做了铺垫。然后,从政府治理的角度,对政府治理青少年网络违法犯罪的相关问题作具体探讨,在借鉴国外治理对策基础上提出通过政府通过完善行政制度调控、强化政府行政监管责任、引导优化网络教育环境、推动互联网行业自律、重视社会监督等应对措施,应对新形势下青少年网络违法犯罪的重大挑战。在青少年网络违法犯罪日益猖獗的今天,政府部门不仅要掌握青少年网络违法犯罪的新动向和发展趋势,而且还要在正确分析面临的不利局面制约因素的基础上,充分履行职责,发挥核心、主导作用,做好防范工作和打击工作。
[Abstract]:With the popularization and development of computer and network technology, the touch of network has been involved in various fields of human society. Network not only brings us a lot of convenience, but also causes a lot of problems. Juvenile network crime is a new type of crime with the emergence and development of the network. Not only its incidence rate increases year by year, spread rapidly, but also destructive power, social harm is very serious. On the basis of investigating the situation of cybercrime at home and abroad and the countermeasures to deal with cybercrime, and from the angle of government governance, this paper probes into the related problems of government in dealing with juvenile cyber crime, and puts forward that the government should regulate and control it by perfecting the administrative system. Strengthen the responsibility of government administration supervision, guide and optimize the network education environment, promote the Internet industry self-discipline, attach importance to the social supervision and other countermeasures, play the core, leading role in the governance of specific prevention and control measures. This paper mainly includes three parts: firstly, it expounds the basic theory of juvenile cybercrime and its government governance. The concept, main characteristics, forms and existing reasons of juvenile network crime. This part begins with the concept of juvenile cybercrime, combining with their own understanding, summarizes the characteristics of juvenile cybercrime, and analyzes the causes of juvenile cyber crime combined with the actual situation. At the same time, it expounds the concept, characteristics and necessity of government governance. Secondly, the paper analyzes the situation of juvenile network illegal crime in our country. This part introduces the present situation investigation of the network illegal crime of our country, sums up the present situation of our country's governance and the existing network legislation is not perfect, the government network supervision is weak, the government administration function offside, the policy guidance to the diversified main body is not in place. To guide the industry self-discipline effect is not obvious, for the next step to put forward the government to deal with network illegal crime countermeasures made the groundwork. Then, from the point of view of government governance, this paper makes a concrete discussion on the related problems of government governance of juvenile network illegal crime. On the basis of drawing lessons from foreign governance countermeasures, this paper puts forward that the government should strengthen the responsibility of government administrative supervision through perfecting the administrative system regulation and control through the government. To guide and optimize the network education environment, promote the self-discipline of Internet industry, attach importance to social supervision and other countermeasures, in order to deal with the major challenges of juvenile delinquency on the Internet under the new situation. In today's increasingly rampant juvenile network crime, government departments should not only master the new trend and development trend of juvenile network crime, but also on the basis of correct analysis of the constraints of the adverse situation faced by them. Fully perform their duties, give play to the core, leading role, do a good job of prevention and combat work.
