司法社会工作在社区矫正中的功能定位及实现路径

【摘要】：司法社会工作是社会工作者运用社会工作的专业知识和方法,为司法领域的特殊案主提供社会工作的专业服务过程。司法社会工作与社区矫正的关系表现为本质上的相异、理念上的交叉、功能上的互补、过程上的统一、主体上的区别等五个方面。司法社会工作在我国现阶段的功能定位应为"司法本位",司法社会工作介入社区矫正,需把握尊重基本人权和尊重犯罪人人权的界限,司法社工应在本职工作范围内发挥作用,辅助刑事执法活动,不能越界。社区矫正执法队伍和司法社工队伍是社区矫正两支不同的专业力量,相互配合并在各自的专业领域发挥同等重要作用。
[Abstract]:Judicial social work is a professional service process in which social workers use the professional knowledge and methods of social work to provide social work to special subjects in the judicial field. The relationship between judicial social work and community correction is manifested in five aspects: the essential difference, the intersection of ideas, the complementarity of functions, the unity of process and the difference of subject. At the present stage, the function orientation of judicial social work in our country should be "judicial standard". When judicial social work is involved in community correction, it is necessary to grasp the boundary between respecting basic human rights and respecting the human rights of criminals. Judicial social workers should play a role in the scope of their own work, assist criminal law enforcement activities, and cannot cross the line. Community correction law enforcement team and judicial social work team are two different professional forces of community correction, which cooperate with each other and play an equally important role in their respective professional fields.
