【摘要】:退工单记载不实极易引起劳动者和用人单位之间的争议。以徐恺诉上海宝钢案为典型的案例即反映了退工单记载不实对劳动者后续就业所产生的负面影响。退工单在性质上是劳动合同解除或终止的证明,由用人单位出具,能够在劳动关系管理中起到一定的作用。退工单记载不实所导致的法律纠纷既可以作为劳动纠纷案件处理,也可以作为名誉权纠纷案件来处理,但是不同的诉讼策略选择会产生不同的后果。本文以徐恺诉上海宝钢案为分析切入,探讨该案背后存在的实体法问题和诉讼策略问题,主要分为如下五个部分:第一部分是引言。引言部分交代了退工单记载不实争议这一法律现象,作为本文研究的背景,并简要地交代了本文的研究目的、研究路径和研究方法,作为全文研究工作的起点;第二部分是徐恺诉上海宝钢案的基本案情及争议焦点,在陈述徐恺诉上海宝钢案基本案情、诉讼请求和抗辩理由、裁判结果的基础上,整理出该案中的争议焦点和裁判分歧,并对该案所反映的核心问题进行了总结,认为该案所反映的是退工单记载不实争议产生后的诉讼策略选择问题:第三部分是本案争议焦点的法律分析。本部分对退工单的概念、性质和作用进行了分析,并反思了退工单记载不实争议案件产生的原因,分析了退工单记载不实案件背后存在的劳资关系失衡;第四部分是本案反映的法律问题,提出徐恺诉上海宝钢案以名誉权纠纷而不是劳动纠纷展开诉讼反映了诉讼策略选择上的优化,原因在于该案以名誉权纠纷案件处理更有利于保护劳动者的合法权益;第五部分是退工单记载不实纠纷案件的司法应对,主要以司法裁判者的视角审视退工单记载不实所致的名誉权纠纷案件在处理中方法和技巧,尤其对注重此类案件的事实认定、证据认定、裁判理由陈述和损害赔偿数额确定予以重点关注。
[Abstract]:The case of Xukai v. Shanghai Baosteel reflects the negative influence of false record on the subsequent employment of the laborer. Only in nature is the labor contract termination or termination of proof. Issued by the unit of choose and employ persons, can play a certain role in the management of labor relations. It can also be dealt with as a reputation dispute case, but different litigation strategies will have different consequences. This article takes Xukai v. Shanghai Baosteel case as the analysis. This paper discusses the substantive law problems and litigation strategies behind the case, mainly divided into the following five parts: the first part is the introduction. As the background of this paper, and briefly explained the purpose of this study, research path and research methods, as the starting point of the full text research work; The second part is the basic case of Xukai v. Shanghai Baosteel and the focus of the dispute, on the basis of the presentation of the basic case of Xukai v. Shanghai Baosteel, litigation request and defense, the results of the judgment. Collate the dispute focus and judgment differences in the case, and the core issues reflected in the case are summarized. It is considered that this case reflects the choice of litigation strategy after the false dispute of withdrawal form is recorded: the third part is the legal analysis of the focus of the dispute in this case. This part analyzes the concept, nature and function of the withdrawal order. It also reflects on the reasons of the case of false dispute, and analyzes the imbalance of labor relations behind the record of false record. The 4th part is the legal problem reflected in this case, and the litigation in the case of Xukai v. Shanghai Baosteel reflects the optimization of the choice of litigation strategy by the right of reputation dispute rather than the labor dispute. The reason lies in the fact that it is more advantageous to protect the legitimate rights and interests of the laborer to deal with the dispute case of reputation right in this case; The 5th part is the judicial response to the false dispute cases recorded by the withdrawal orders, mainly from the perspective of the judicial adjudicators to examine the methods and techniques in the handling of reputation disputes caused by the false record of the withdrawal orders. Especially focus on the facts of such cases, evidence, the statement of reasons and damages to determine the amount of focus.
