中国与俄罗斯能源合作的法律机制研究

【摘要】：本文从中国和俄罗斯在石油、天然气、电力以及核能等各个能源领域合作的现状出发,从法律角度得出了中俄能源合作的特点,中俄能源合作往往是先由双方政府签订合作的框架性协议,在此基础上再由双方的企业签订和实施具体合作合同。接着本文对中俄两国能源合作的法律依据全面梳理,并进行了有效性评析,认为两国能源合作的法律依据缺乏有效性。进而本文从两国国内法律制度、双边法律机制和在多边框架下三个方面分析了中俄能源合作法律机制的缺陷。在中国方面,尚没有建立完整的对外能源合作法律体系,政府和企业的行为都有不足；在俄罗斯方面,法律制度对能源投资者不利且不稳定；在双边法律机制方面,中俄的能源合作缺乏有效的法律依据和保障,而且双方政府和企业所签订的协议类型和内容都比较单一；中俄没有同时加入任何一个全球性的专门的能源国际组织或国际条约,在区域性组织中的能源合作也有局限性。最后,本文提出了完善中俄能源合作法律机制的建议。在内国法律制度上,以中国对外能源合作法律制度的完善为重点,提出了企业对外投资风险保障制度、融资制度、信息合作制度、税收制度、能源环境保护、能源储备等多方面的建议。在双边保障机制上,对中俄双边能源合作法律体系以及各组成部分的完善提出了建议。对在国际组织和国际条约框架下加强中俄能源合作也提出了多方面的建议。通过各层面法律机制的完善,希望能为我国与俄罗斯今后的能源合作和保障我国能源安全搭建一个良好的法律制度框架。
[Abstract]:Starting from the current situation of cooperation between China and Russia in the fields of oil, natural gas, electricity and nuclear energy, this paper draws the characteristics of Sino-Russian energy cooperation from the legal point of view. Energy cooperation between China and Russia is usually a framework agreement of cooperation signed by the governments of both sides first, and then signed and implemented by the enterprises of both sides on this basis. Then, this paper comprehensively combs the legal basis of energy cooperation between China and Russia. The effectiveness of the two countries is evaluated and the legal basis of energy cooperation between the two countries is lack of effectiveness. Then this paper analyzes the defects of the legal mechanism of Sino-Russian energy cooperation from three aspects: domestic legal system, bilateral legal mechanism and multilateral framework. In China, there is no complete legal system for foreign energy cooperation. In Russia, the legal system is disadvantageous and unstable to energy investors. In terms of bilateral legal mechanisms, Sino-Russian energy cooperation lacks an effective legal basis and protection. Moreover, the types and contents of the agreements signed by the two governments and enterprises are relatively single. China and Russia have not joined any special global energy international organizations or international treaties at the same time, and their energy cooperation in regional organizations is also limited. Finally, this paper puts forward some suggestions on how to perfect the legal mechanism of Sino-Russian energy cooperation. In the legal system of China's foreign energy cooperation, the author puts forward the risk guarantee system and financing system of enterprise's foreign investment. Information cooperation system, tax system, energy environment protection, energy reserve and so on. Suggestions are made for the perfection of the legal system and various components of bilateral energy cooperation between China and Russia, as well as for the strengthening of Sino-Russian energy cooperation under the framework of international organizations and international treaties. It is hoped that a good legal framework can be set up for the future energy cooperation between China and Russia and the protection of China's energy security.
