运用法治思维、法治方式推进和规范改革

【摘要】：运用法治思维和法治方式推进和规范改革,一要坚持规则至上,引领改革方向,使改革与规则深度互动,相向而行,牢固确立规则至上的理念和思维,确保规则的到位跟进;二要坚持权利本位,平衡改革利益,将权利本位作为划分权利与义务的根基,作为界定合法与非法的依据,并使其成为人权保障的具体体现;三要坚持权力控制,保障改革进程,将权力控制作为惩罚越权行为的法宝,切实坚持"法无授权不可为"及"法定职责必须为";四要坚持程序优先,规范改革程序,程序优先是协调利益的实现方式,是保障改革秩序的基本方式,体现在对司法程序的尊重。
[Abstract]:To promote and standardize the reform by using the thinking of rule by law and the way of rule by law, first, we should insist on the rule first, lead the reform direction, make the reform and the rule of law interact with each other in depth and go in the opposite direction, firmly establish the idea and thinking of the rule first, and ensure that the rule is in place and follow up; Second, we should adhere to the right standard, balance the interests of reform, take the right standard as the basis for dividing rights and obligations, as the basis for defining legality and illegality, and make it a concrete embodiment of the protection of human rights; third, we should insist on power control. To safeguard the reform process, to use power control as a magic weapon for punishing ultra vires, to earnestly insist on "the law cannot be authorized without authorization" and "the legal duty must be done"; fourth, to insist on giving priority to procedures and to standardize reform procedures. Procedural priority is the realization of coordinated interests and the basic way to guarantee the reform order, which is embodied in the respect of judicial procedure.
