中美新能源贸易摩擦问题评析

【摘要】:在新能源产业上,我国与美国起点相近,现在中、美两国都将经济转型发展的重点放在具有战略性的新能源产业上,已经进入利益碰撞期,围绕新能源产业的贸易摩擦呈常态化将是不可避免的趋势,需要谨慎研究对策。美国启动对我国新能源产业的301调查,主要的争议在于我国对新能源产业提供的优惠措施是否属于SCMA协议所规定的专项性补贴,这是区分正当的经济社会政策,还是扭曲国际贸易、剥夺其他国家合法贸易机会的不公平贸易行为的关键。我国政府在维护国家利益、积极抗辩的同时,应完善新能源政策法律体系,一方面参照WTO规则和美国的一些成功做法,改进我国的扶持政策,发挥政府的主导作用,加强对新能源发展规划协调、标准规范制定以及对技术研发的支持,开拓国内市场;另一方面推动新能源企业走出去,主动打破国际贸易壁垒。
[Abstract]:In the new energy industry, China and the United States have similar starting points. Now, both China and the United States have put the emphasis of economic transformation and development on the strategic new energy industry, and have entered a period of conflict of interests. It will be an inevitable trend to normalize the trade frictions around the new energy industry, and we need to study the countermeasures carefully. The United States has launched a 301 survey on the new energy industry in China. The main controversy lies in whether the preferential measures offered by China to the new energy industry are specific subsidies stipulated in the SCMA Agreement, which distinguish between legitimate economic and social policies or distorting international trade. The key to unfair trade behavior that deprives other countries of legal trade opportunities. While safeguarding national interests and actively defending, our government should improve the legal system of new energy policies, on the one hand, referring to the WTO rules and some successful practices of the United States. To improve China's support policies, to give play to the leading role of the government, to strengthen coordination of new energy development plans, to formulate standards and norms, and to support technology research and development, to open up the domestic market; on the other hand, to promote new energy enterprises to go out. Take the initiative to break down international trade barriers.
