法律硕士教育改革的对策性研究

【摘要】: 从1996年到2009年,法律硕士专业学位教育已走过了十几个年头,逐渐成为我国法学教育与法律人才培养制度中的重要模式,并在法治发展进程中起到重要作用。在我们取得令人瞩目成绩的同时,也应意识到法硕培养实践中的诸多问题均需要我们谨慎面对,认真解决。为此,本文立足于我国法律硕士教育现状的实证调查,以大量的统计数据为基础,分析研究了法律硕士教育存在问题并试图提出几点改革建议。 本文第一部分通过全面梳理、剖析法律硕士教育的政策文件,深刻解读了法律硕士专业学位教育的培养目标,并立足于我国法律硕士教育现状的调查,揭示了目前法律硕士教育存在的三大问题:法律硕士预期培养目标未能落实、培养模式严重失范以及法律硕士教育实效与社会需求脱节。 本文第二部分在明确定位法律硕士教育培养目标的基础上,提出我们还需进一步树立法律硕士教育理念的新思维,既要树立法律硕士教育的神圣使命感与责任感,又要树立整体化知识教育和柔性教育的理念。 本文第三部分针对目前法律硕士培养环节的种种弊端,提出科学规范法律硕士培养环节的四点举措:完善法律硕士录取考试制度、建立合理的法律硕士课程体系、探索多样化的教学手段并且要合理配置教育资源。 本文第四部分分析研究了法律硕士教育的制度完善,强调建立健全“法硕指”的工作机制,并建构多层次的法律硕士教育评价体系以保障法律硕士教育人才培养质量,通过建立全方位的交流合作机制共同促进法律硕士教育的改革。
[Abstract]:From 1996 to 2009, law master degree education has gone through more than ten years, and has gradually become an important model in the legal education and legal personnel training system in China. And play an important role in the development of the rule of law. While we have made remarkable achievements, we should also realize that many problems in the practice of training should be carefully faced and solved. Based on the empirical investigation of the present situation of the Master of Law education in China and based on a large number of statistical data, this paper analyzes and studies the problems existing in the education of the Master of Law and tries to put forward some suggestions for reform. In the first part of this paper, the author analyzes the policy documents of law master's education, deeply interprets the training target of law master's degree education, and bases on the investigation of the present situation of law master's education in our country. This paper reveals three major problems existing in the education of master of law at present: the failure of the expected training goal of the master of law, the serious anomie of the training model and the disconnection between the effectiveness of the education of the master of law and the needs of the society. In the second part of this paper, on the basis of defining the training goal of the master of law education, it is pointed out that we should further establish the new thinking of the concept of the master of law education, and establish the sacred sense of mission and sense of responsibility of the master of law education. We should also set up the concept of integrated knowledge education and flexible education. In the third part of this paper, aiming at the malpractice of the current training link of master of law, the author puts forward four measures to standardize the link of training of master of law scientifically: perfecting the examination system of master of law, establishing a reasonable course system of master of law. Explore a variety of teaching methods and reasonable allocation of educational resources. In the 4th part of this paper, the author analyzes and studies the perfection of the law master education system, emphasizes the establishment and improvement of the working mechanism of the law master education, and constructs a multi-level evaluation system of the law master education to ensure the quality of the legal master education personnel training. Through the establishment of a comprehensive exchange and cooperation mechanism to jointly promote the reform of master of law education.
