【摘要】： 本文着眼于“约法三章”的解释,尽笔者所能,结合简牍、文献所见的相关记载,以期把握“约法三章”的内在特质。具体地说,通过字面含义的解释,弄清“约法三章”一词的流变,从而更加清晰的认识刘邦“约法三章”这一事件,并在此基础上,联系当时的社会背景,结合出土的睡虎地秦简和张家山汉简的相关内容,进一步考证“三章”之法的具体律名。文章由四个部分组成：了解刘邦提出“约法三章”的历史背景对我们理解并考证“约法三章”至关重要,基于此,笔者用大量篇幅来叙述刘邦提出“约法三章”的背景,并将此部分独列一章放在全文开头,是想起到强调的作用。第二章主要探讨“约法三章”的字面含义。通过对“约”、“法”和“三章”的考察,“约法三章”一词的流变情况就会迎刃而解,从而,作为“约法三章”一词的起源,刘邦提出“约法三章”这一历史事件也将更加清晰。而“三章”之法作为“约法三章”的重要内容,笔者也将在本章考察。第三章主要联系当时的社会背景,并结合睡虎地秦简和张家山汉简的相关内容,对“三章”之法的律名加以分析、筛选,从而找出刘邦与父老“约”的“三章”之法的具体内容。文章的最后主要论述刘邦“约法三章”的目的及意义。
