论韩国混合法文化的历史演进

【摘要】： 混合法文化的形成和发展通常是与某个国家或地区特殊的历史、文化紧密相连的。韩国在历史发展过程中形成了独具特色的混合法文化,成为混合法研究的重要对象。为了厘清韩国混合法文化发展的每个重要时段,文章采用历史研究法、比较研究法和个案研究法,分别从纵向和横向两个维度探析韩国混合法文化的发展进路。文章以韩国历史发展为主线,梳理了其混合法文化的发展脉络。封建社会时期,在儒家传统文化的熏陶下,韩国全面继受中国法,儒家法律文化对韩国社会的稳定发展起到了积极的促进作用。朝鲜王朝末期,韩国法逐渐朝大陆法系靠近,在法学思想、法典编纂和司法运用等方面进行移植,其中,又数德国法对韩国法的影响最为深刻。日本殖民统治时期,韩国法的自主发展遭到抑制,日本法成为日本在朝鲜半岛的殖民统治工具,这深刻影响着韩国法日后的发展方向。第二次世界大战结束后,世界政治格局重新划分,韩国在美国的主导下建立了资本主义国家体系,韩国法文化亦明显受到英美法系,尤其是美国法的影响,各主要部门法中逐渐导入了美国法的概念和要素。以大陆法系为核心的韩国法日益成为两大法系交汇融合的典型。韩国混合法文化发展的整体特征可以概括为:从封建时代的礼主法从到近代以来法与礼的分化;从对传统法的墨守成规到对西方法的主动移植;从法的工具性逐步达致法的目的性;从固有法的单一性到混合法的多元性。韩国法发展的历程表明,只有扎根于对本国法治资源的探索,根据国情主动学习吸收世界先进法治思想和法学理论,才能走出一条符合本国特色的法治道路。从这一层面来说,加深对韩国混合法文化的研究,将对我国法治社会的完善起到一定的参照和启示作用。
[Abstract]:The formation and development of mixed law culture is usually closely related to the special history and culture of a certain country or region. In order to clarify each important period of the development of Korean mixed method culture, the article adopts the historical research method, the comparative research method and the case study method. This paper analyzes the development of Korean mixed method culture from the vertical and horizontal dimensions. Taking the historical development of Korea as the main line, the article combs the development context of its mixed legal culture. During the feudal society, Korea was fully followed by Chinese law under the influence of Confucian traditional culture. The Confucian legal culture has played a positive role in promoting the steady development of Korean society. In the end of the Korean Dynasty, the Korean law gradually moved closer to the continental law system and transplanted in the aspects of legal thought, codification and judicial application, among which, During the period of Japanese colonial rule, the independent development of Korean law was restrained, and Japanese law became a tool of Japanese colonial rule on the Korean Peninsula. After the end of the second World War, the political structure of the world was redivided. South Korea established a capitalist state system under the leadership of the United States, and the Korean legal culture was obviously also subject to the Anglo-American legal system. Especially under the influence of American law, the concepts and elements of American law have been gradually introduced into the main branches of law, and the Korean law, with the continental law as the core, has increasingly become a typical example of the convergence of the two major legal systems. The overall characteristics of the cultural development of Korea's mixed law can be summarized as follows: from the feudal period to the division of the law and ritual from the feudal era to the modern times, from the traditional law to the initiative transplantation of the western law, and from the traditional law to the initiative transplantation of the western law. From the instrumental nature of law to the purpose of law, from the singularity of inherent law to the pluralism of mixed law, the course of the development of Korean law shows that it is only rooted in the exploration of the resources of the rule of law in our country. According to the national conditions, we can actively study and absorb the world's advanced legal thoughts and legal theories, so that we can walk out a road of rule of law that conforms to our own characteristics. From this level, we should deepen the study of Korean mixed law culture. It will play a certain reference and enlightenments to the perfection of our country's legal society.
