试论《管子》的立法思想及其现实意义

【摘要】： 管仲是先秦时期著名的政治家、思想家,而《管子》一书,学界普遍认为是古代的稷下学者们托管仲之名所著。就其内容而言,《管子》就是一本大百科全书,它的思想丰富而深刻,涵盖了法律、政治、军事、经济、科技等多个方面。在《管子》的诸多思想中,又尤以其法律思想最为突出。书中大量的关于法律制度的记载,是研究先秦法制史不可多得的资料。《管子》关于法的起源,法的性质和作用,法律的制定和执行等方面的论述,精辟而深刻；一些有名的论断,如“以法治国”,至今仍为我们所提倡和沿用。只有对其法律思想进行考察,我们才能够对《管子》的思想体系有一个总体的把握。在《管子》系统而丰富的法律思想中,其立法思想占有重要的地位。《管子》较为全面地阐述了立法应遵从天道、顺应民心；立法要因时、因俗而变；立法应宽严适度,公开透明等一系列关于立法的基本原则问题。毫无疑问,这些呈现出了超越时代的理性光芒,至今仍然极具借鉴意义。多年来,学者们已分别从多个方面对《管子》的法律思想进行了探索和阐述。他们或者研究其法律思想的特点,或者辨析其法律的概念,或者分析其与秦晋法家的区别,或者考察其立法、执法特点,或者考察法律与其它社会关系或文化的关系,但深入考究其立法思想的文章却不多见。这对人们准确地理解先秦时期的法律思想造成了一定的影响。正是出于这一考虑,本文广泛搜集资料,参考、借鉴相关的研究成果,运用历史的、辩证的分析研究方法,梳理了《管子》的立法思想的内容及特点,以期能够全面、系统地展现《管子》立法思想的全貌。《管子》立法思想的研究对当代中国法制建设具有重大意义,其中体现出来的天人合一、德法并举、家国和谐的思想不仅可以而且完全应当被吸收借鉴,用来为今天的法治建设服务,为当前建设社会主义和谐社会服务。我们只有立足于中国传统文化,汲取其精髓,结合当代中国的国情,才能建立起适合当代中国的法制体系,才能实现真正的法治社会。

Only we should advocate and to investigate its legal thoughts, we will be able to "pipe system > is an overall grasp.

For this reason, the extensive collection of information reference, drawing on related research results, using historical analysis, dialectical method the content and characteristics, combing the idea of legislation of < > tube, in order to comprehensively and systematically show the whole theory of legislation < >.
