英国信托财产独立性的引介性分析

【摘要】： 信托制度发源于英国,它集中体现了英美法理论和司法制度的特点。是英国独特的历史、文化和司法制度的产物。然而如果没有可辨识的、独立的财产,也就没有信托,所以信托财产处于信托关系的核心地位。其中,信托财产的独立性是信托财产的一个重要特征。信托财产的独立性,是指虽然受托人拥有信托财产的所有权,但信托财产要受到信托目的的限制,信托财产基于信托目的而独立存在。信托财产的地位独立于委托人、受托人、受益人三方当事人的自有财产,三方当事人的债权人的也无权追及追及。基于信托财产独立性的原则建立的一系列完善的信托制度,如财产制度,信托关系中三方当事人的权利义务分配,相关利害关系人的权利保护等充分发挥了信托的功能。为了使信托我国的信托制度的功能得到充分的发挥,尽快使信托制度融入我国的法律体系,以及在“信托财产独立性”原则的基础上尽快完善相关的信托制度设计,笔者对英国信托财产独立性进行了引进和介绍性的分析研究,希望能够对我国信托法的进一步完善有所助益。
[Abstract]:The trust system originated in England. It embodies the characteristics of Anglo-American law theory and judicial system. It is the product of Britain's unique history, culture and judicial system. However, if there is no identifiable, independent property, there will be no trust. The independence of the trust property is an important characteristic of the trust property. The independence of the trust property means that although the trustee owns the ownership of the trust property, However, the trust property must be restricted by the purpose of the trust, and the trust property exists independently on the basis of the purpose of the trust. The status of the trust property is independent of the own property of the trustor, the trustee and the beneficiary. Based on the principle of the independence of trust property, a series of perfect trust systems, such as the property system, the distribution of rights and obligations of the three parties in the trust relationship, In order to give full play to the function of trust system in our country, the trust system can be integrated into our country's legal system as soon as possible. And on the basis of the principle of "independence of trust property", the author makes an introduction and an introductory study on the independence of trust property in Britain. Hope to be able to further improve the trust law in China.
