【摘要】： 立法听证的确立,无疑为社会公众提供了一个合法的、有效的展现其利益博弈的参与平台。立法听证以看得见的程序性形式,赋予利益相关人表达自身利益的权利和与他方博弈的机会,这有利于缓和社会潜在的危机,维护政治稳定,促进社会和谐。然而,在我国立法听证这个实践平台上,相关利益主体的缺位、博弈不均衡、听证后缺乏后续处理等问题使立法听证的效能没有很好地发挥出来,易使立法听证成为一种仅有纯粹表达没有抗辩的“走过场”的形式。本文从利益博弈的视角去研究立法听证,是要探讨与把握立法听证中的利益博弈过程,分析立法听证中利益博弈各方参与力量以及实践中存在的问题,并提出各种规范立法听证的措施,完善立法听证制度,促进利益博弈的均衡化。
[Abstract]:The establishment of the legislative hearing undoubtedly provides a legal and effective platform for the public to participate in the game of interests. Giving stakeholders the right to express their own interests and the opportunity to play games with other parties is conducive to easing the potential crisis of society, maintaining political stability and promoting social harmony. However, on the practical platform of legislative hearing in our country, The absence of relevant stakeholders, the imbalance of game and the lack of follow-up after the hearing make the efficiency of the legislative hearing not play a good role, and it is easy to make the legislative hearing become a "formality" which only expresses no defense. The purpose of this paper is to study the legislative hearing from the angle of interest game, to explore and grasp the process of interest game in the legislative hearing, to analyze the participating power of the parties involved in the interest game and the problems existing in practice in the legislative hearing. It also puts forward various measures to standardize the legislative hearing, perfect the system of legislative hearing, and promote the equalization of interest game.
