试论中国古代易俗令与违制律

【摘要】: 违制律,亦称“制书有违律”,自晋代起一直在传统刑法典中起到帮助法律推理的功能,同时对礼教秩序和皇权统治起到补充维护作用。 中国古代的服饰、发式等习俗一直是传统文化的载体,属于“礼”所规范的内容。中国历代王朝为巩固自身的统治,曾数度颁布“易俗令”,其中尤以清代施行的剃发易服令持续最久、范围最广、影响最大、引发冲突最多。统治者将衣冠服饰等这些本用“礼”来规范的内容,强行划入由律令惩治的范畴,同时为避免“律无罪名”,将其统一纳入违制律,使之成为其出“礼”入“法”的工具,为这一类的司法擅断提供了“合法性”依据。 论文通过对“易俗令”与违制律的历史沿革的梳理,对其历史教训和现实影响的分析比较和研究,结合时代背景和社会、经济、文化的发展,对其存在的合理性与制度缺陷进行初步的探讨。
[Abstract]:Since the Jin Dynasty, it has been playing a role in helping the legal reasoning in the traditional criminal code, at the same time, it has played a supplementary role in maintaining the order of etiquette and the rule of imperial power. Ancient Chinese dress, hairstyle and other customs have been the carrier of traditional culture, belong to the "ritual" standard content. Chinese dynasties in order to consolidate their own rule, There have been several times of "changing customs", especially in the Qing Dynasty, where the order of shaving and changing clothes lasted the longest, most widely, had the greatest influence and caused the most conflicts. The rulers used "ritual" to regulate the dress and dress of the rulers. In order to avoid the "law not guilty", to bring it into the violation of the law, and to make it the tool of "courtesy" into "law", it provides the basis of "legality" for this kind of judicial arbitrariness. Through combing the historical evolution of "changing customs" and violating the rules of control, the paper analyzes and compares the historical lessons and the practical effects, and combines the background of the times with the development of society, economy and culture. The rationality of its existence and institutional defects are preliminarily discussed.
