元代宪司分行录囚述论

【摘要】：在中国传统的政治架构中,监察机构与监察官员始初也担负诸如录囚的任务,但其后,监督、监察官僚体系则成为其主要的职责。元代宪司即地方监察机构却在实施行政监察职能的同时,定期地、大量地承担了录囚的司法职责。在录囚中,除了审录数量相对较少的重囚外,对于其他的囚犯,元政府则规定了宪司分行"决轻"、"辩冤"、"纠滞"、"申疑"等录囚任务。在录囚中,宪司不仅审录在押犯人,还审录正在诉讼过程中的案件。同时,对录囚中发现的贪赃、枉法、违法行为的官员予以惩处或者上报惩处意见。至于录囚的效果,不排除一些正直官员的严正执法与人道表现,但作为封建制度体系中的元代,录囚不可能彻底解决司法腐败与社会黑暗问题,而且录囚本身的弊病也大量存在。
[Abstract]:In China's traditional political structure, supervisory bodies and supervisory officials were initially charged with tasks such as incarceration, but since then, they have been overseen. In the Yuan Dynasty, the Secretary for Constitutional Affairs, that is, the local supervisory organ, carried out the administrative supervision function, and at the same time, he took on a large number of judicial responsibilities of the inmates on a regular basis. In addition to the relatively small number of remanded prisoners, for other prisoners, the Yuan Government has stipulated the duties of the Secretary for Constitutional Affairs, such as "light," "defending grievances," "correcting delays," and "filing doubts." in the custody of prisoners, the Secretary for Constitutional Affairs not only interrogates prisoners, At the same time, officials found in custody of corruption, perversion of the law, and illegal acts should be punished or reported to the public for disciplinary opinions. As for the effect of recording prisoners, Yan Zheng did not rule out the law enforcement and humane performance of some honest officials, but as the Yuan Dynasty in the feudal system, the judicial corruption and the social darkness could not be solved completely, and the malady of the incarceration itself also existed in a large number.
