个案全过程教学:在素质教育基础上的能力培养

【摘要】：正法学院的学生学什么或者说法学院的教师教什么,是一个尚未真正解决的问题。前不久教育部网站上公布的法学专业核心课程目录"由于操作人员的失误"而"漏掉"了中国法制史和经济法两门课,引起轩然大波。经学者们"据理力争",教育部很快"纠正网络错误",将这两门课程补正为法学专业的核心课程。事后还有学者联名致函教育部,予以表扬。表面看来,这是一场因工作人员技术失误带来的闹剧,实则是有关法学教育方向的一场角逐,至少是部分学者(当然也是法学院的教师)在这个问题上表达了对法学教育方向的担忧,尽管也可能会被人误解为"保卫饭碗"的战斗。因此,我们在此议论个案全过程教学方法,确有必要在更广阔的视野内讨论法学院的教育——素质教育、能力培养以及它们之间的关系问题。
[Abstract]:What does a law school student learn or what a law school teacher teaches? Not long ago, the Ministry of Education published on its website the catalogue of the core courses of law major, "due to the mistakes of the operators," and "missed" the two courses of Chinese legal history and economic law. This caused a great uproar. After the scholars "argued hard", the Ministry of Education soon "corrected the network error" and corrected the two courses as the core course of the law major. Afterwards, some scholars sent a joint letter to the Ministry of Education to praise them. On the face of it, This is a farce caused by technical mistakes on the part of the staff. In fact, it is a contest about the direction of law education. At least some scholars (and, of course, law school teachers) have expressed concern about the direction of law education on this issue. Although it may also be misinterpreted as a battle to "defend the rice bowl," we are here to talk about the whole-course teaching method of individual cases, and there is a need to discuss the education of law schools-quality education in a broader context.
