【摘要】： 地方经济立法是宪法和法律赋予部分地方人大及其常委会和人民政府的一项重要职权,是社会主义法制建设的重要组成部分。科学发展观是马克思主义关于发展的世界观和方法论的集中体现,是我国经济社会发展的重要指导方针,是发展中国特色社会主义必须坚持和贯彻的重大战略思想。法律法规是党的主张和人民意志的统一。坚持正确的指导思想,是做好地方经济立法工作、提高地方经济立法质量的根本保证。在地方经济立法中树立和落实科学发展观是一个重大的理论和实践课题。本文首先论述地方经济立法的基础理论,分析地方经济立法的涵义、法律依据和现行体制,阐述其三个价值目标。然后,指出当前我国地方经济立法存在的问题,主要分析了长期以来地方经济立法理念中存在错误意识问题,提出了我国地方经济立法工作中存在的突出具体问题。第三部分阐述怎样在地方经济立法的理念上树立和落实科学发展观,提出确立以科学发展观为核心的地方经济立法理念。最后提出解决地方经济立法工作中突出的三方面问题的具体途径。
[Abstract]:Local economic legislation is an important function and power conferred by the Constitution and laws on some local people's congresses and their standing committees and people's governments. The concept of scientific development is a concentrated embodiment of Marxism's world outlook and methodology on development, and an important guiding principle for China's economic and social development. Is the development of socialism with Chinese characteristics must adhere to and implement the major strategic thinking. Laws and regulations are the unity of the Party's stand and the will of the people. To adhere to the correct guiding ideology is to do a good job in local economic legislation. It is an important theoretical and practical task to improve the quality of local economic legislation and to establish and implement the scientific concept of development in local economic legislation. This paper first discusses the basic theory of local economic legislation, analyzes the meaning, legal basis and current system of local economic legislation, and expounds its three value objectives. This paper mainly analyzes the problem of erroneous consciousness in the concept of local economic legislation for a long time. In the third part, the author expounds how to establish and implement the scientific concept of development in the concept of local economic legislation. This paper puts forward the idea of establishing the local economic legislation with the scientific development view as the core, and finally puts forward the concrete ways to solve the three outstanding problems in the local economic legislation.
