全日制法律硕士模拟法庭课程规范研究

【摘要】: 全日制法律硕士专业以培养宽口径、实践型、复合型的法律人才为目标,更注重于法学基础理论的学习和法律实务技能的培训。而由于法律硕士专业起步较晚,加之我国法学教育历来“重理论、轻实践”的传统,使这一目标的实现还有很大一段距离。近几年来,随着我国法学教育的培养模式逐渐从“理论人才培养”模式向“应用型人才培养”模式的转变,相应的教学模式也亟待转变。模拟法庭教学方法以其独特的教学形式、理论课无法比拟的显著优势应运而生,成为目前高校法学院系,尤其是全日制法律硕士普遍采用的一种新型的教学模式。模拟法庭课程是指在教师的指导下,以学生为主体,运用所学知识,借助一定设备,模仿法庭审判的一种实践性法学教学活动。这一教学模式正好符合了法律硕士的培养目标,也是全日制法律硕士的必修课程,是从理论走向实践必不可少的环节。但是,目前这一教学模式在实践中还存在许多问题,抑制了其自身效能的充分发挥。因此,本文就从模拟法庭课程概况谈起,通过比较分析美国的诊所式法律教学模式,从中找出值得借鉴的经验,再对目前全日制法律硕士开展模拟法庭课程情况的现状分析,提出存在的问题,针对这些问题以及全日制法律硕士的特点探索出适合自身发展和培养目标的模拟法庭课程的教学设计。本文作为一篇研究型论文,不仅有助于模拟法庭课程这门法学职业训练课程的完善又涉及到教学法的内容。对这一问题的规范研究不仅对突出全日制法律硕士以培养实践型、复合型人才为宗旨的特色有益,而且对法律硕士教学模式的创新完善以及拓展法学教师的法律职业能力等方面均有重大现实意义。
[Abstract]:Full-time master of law majors aim at cultivating wide-caliber, practical and complex legal talents, and pay more attention to the study of basic theory of law and the training of legal practical skills. In addition, the tradition of "attaching importance to theory rather than practice" in China's legal education has made the realization of this goal a long way from being realized. In recent years, With the gradual transformation of the training mode of law education from "theory talent training" to "applied talent training", the corresponding teaching mode needs to be changed urgently. The simulated court teaching method has its unique teaching form. The incomparable advantages of theoretical courses have emerged as the times require, and have become a new teaching mode in law departments of colleges and universities, especially full-time masters of law. Simulated court courses refer to students as the main body under the guidance of teachers. With the help of certain equipment and using the knowledge learned, the author imitates a kind of practical law teaching activity in court trial. This teaching mode is in line with the training goal of the master of law, and is also a compulsory course for the full-time master of law. It is an indispensable link from theory to practice. However, there are still many problems in the practice of this teaching model at present, which restrain the full exertion of its own efficiency. Through the comparative analysis of the clinical law teaching mode in the United States, the author finds out the experience to be used for reference, and then analyzes the current situation of the full time law master's moot court course, and puts forward the existing problems. In view of these problems and the characteristics of the full-time master of law, this paper explores the teaching design of the simulated court course suitable for its own development and training objectives. It is not only helpful to the perfection of mock court course, which is also related to the content of teaching method, but also to the content of teaching method. The normative study on this problem is not only to highlight the full-time master of law in order to cultivate the practical type. The characteristic of compound talents is beneficial, and it is of great practical significance to the innovation and perfection of the teaching mode of master of law and the expansion of the legal professional ability of law teachers.
