法治体系是对法律体系的承继和发展

【摘要】：法治体系和法治国家并列为依法治国的战略目标,标志着我国法治建设从法律体系一维建设的探索到制度实践多维推进的历史性飞跃。基于法治道路的中国特色,法治体系的结构在四中全会决定中定位于涵盖法律规范、法治实施、法治监督、法治保障、党内法规五大体系整体建设的系统工程。实现中国特色法治体系建构的理想图景不仅需要借鉴世界各国法治模式符合我国国情的合理成分,还应立足于中国法治实践,不断推进和深化立法、行政、司法诸领域的制度改革和机制完善,坚持以科学立法、严格执法、公正司法、全民守法的法治方针为引领,以法治理论体系建设为基础,结合中国法治建设实践的经验命题,全面推进法治中国建设理想图景的实现。
[Abstract]:The system of rule of law and the country under the rule of law are the strategic goals of governing the country according to law, which marks the historic leap from the one-dimensional construction of the legal system to the multi-dimensional promotion of the practice of the legal system in our country.Based on the Chinese characteristics of the road of the rule of law, the structure of the system of rule of law is fixed in the decision of the fourth Plenary session of the CPC Central Committee to cover the systematic engineering of the overall construction of the five major systems, including the legal norms, the implementation of the rule of law, the supervision of the rule of law, theTo realize the ideal picture of the construction of the system of rule of law with Chinese characteristics, we should not only draw lessons from the reasonable elements of the model of the rule of law in various countries in the world, but also base ourselves on the practice of the rule of law in China, constantly promote and deepen the legislation and administration.The system reform and mechanism improvement in various fields of judicature is guided by the principle of scientific legislation, strict enforcement of law, just administration of justice, and law-abiding by the whole people, based on the construction of the theoretical system of the rule of law, and combined with the empirical proposition of the practice of the construction of the rule of law in China.We will comprehensively promote the realization of the ideal prospect of building China under the rule of law.
