《德国反国际恐怖主义法》及其对我国反恐立法的借鉴

【摘要】： 恐怖主义的蔓延,给国家和人们带来了灾难,各国都在积极制定和完善本国的反恐立法来预防和打击恐怖主义犯罪。德国作为欧盟重要的一员,在反对国际恐怖主义斗争中发挥着重要的作用,付出了极大的努力,并积累了一定的经验。由于德国同我国一样是大陆法系国家,虽然法律制度不同,但有许多地方值得学习与借鉴。在“9.11”事件发生后,德国在2002年1月9日经参议院同意,联邦议会通过了《德国反国际恐怖主义法》,有效期至2007年1月。该法主要是对德国国内现行的反对恐怖主义领域的法律进行修正,其目的在于弥补原有法律漏洞,更好地打击和预防恐怖主义犯罪。作为该法的延续,2007年1月5日德联邦议会通过《德国反恐怖主义补充法》。本文除引言和结语外,共分为以下四个部分:首先,简要介绍了《德国反国际恐怖主义法》的立法概况,包括立法发展、立法背景和立法模式;其次,论述了其立法内容,根据其内容的关联性大致分为九个方面;再次,对其立法进行评析,从立法特色、立法价值和立法效果三个方面着手;最后,归纳其立法之启示并论及对我国反恐立法之借鉴。
[Abstract]:The spread of terrorism has brought disaster to the country and people. All countries are actively developing and perfecting their anti-terrorism legislation to prevent and combat terrorist crimes.As an important member of the European Union, Germany plays an important role in the struggle against international terrorism and has made great efforts and accumulated certain experience.Because Germany is a civil law country like our country, although the legal system is different, there are many places to learn and learn from.Following the events of 9 / 11, Germany passed the German Anti-International Terrorism Act, which is valid until January 2007, with the consent of the Senate on January 9, 2002.The main purpose of this law is to amend the existing laws in the field of terrorism in Germany. The purpose of the law is to make up for the loopholes in the original laws and to better combat and prevent the crime of terrorism.As a continuation of the Act, the German Federal Parliament passed the German Supplementary Act against Terrorism on January 5, 2007.In addition to the introduction and conclusion, this paper is divided into the following four parts: first, briefly introduces the legislative overview of the German Anti-International Terrorism Law, including the legislative development, legislative background and legislative model; secondly, discusses its legislative content.According to the relevance of its content, it is divided into nine aspects; thirdly, it evaluates its legislation from three aspects: legislative characteristics, legislative value and legislative effect. Finally, it summarizes the enlightenment of its legislation and discusses the reference to our country's anti-terrorism legislation.
