《保护文学和艺术作品伯尔尼公约》的功能文体分析

【摘要】： 法律是权力的体现,法律语言也应体现权力性这种特征。本文探索了法律语言的权力性是如何在语言中得以体现。作者以国际知识产权法中的《保护文学和艺术作品伯尔尼公约》(以下简称《伯尔尼公约》)为个案,从社会语言学角度着手,以韩礼德的系统功能语言学理论为基础,研究其中的语言现象,并分析这些现象所表现的语言特征,由此找出法律语言的语言特征。本文从Halliday的系统功能语言学的角度对《伯尔尼公约》的语言特点进行了小句层和话语层的功能文体分析。本文分别从篇章功能(textual function)分析了主位系统的特点;从人际功能(interpersonalfunction)分析了语气系统的特点;从概念功能(ideational function)分析了文本的及物性系统及其过程和语态的特点;从字形和词汇方面分析了文本的语言特点;从语法隐喻、衔接系统和情景语境方面分析了文本的语言特点。本文的结论是法律语言具有权威性、精确性、简约性、中立性,连贯性和保守性的语言特征;法律语言的权力性由以上语言特征共同体现,并从语言系统中做出相应的功能性选择而形成。本文运用系统功能语言学理论对法律文本《伯尔尼公约》进行法律语言特征的研究属于语言学与法学的跨学科研究。作者期望通过这项研究工作的成果一方面使得语言学习者熟习法律专业语言,另一方面能够让立法者、管理者和从事知识产权工作的相关专业人员更好地理解、掌握和应用《伯尔尼公约》,从而更有效、更一致地保护中国的知识产权。
[Abstract]:Law is the embodiment of power, and legal language should also embody the characteristic of power.This paper explores how the power of legal language can be embodied in language.The author takes the Berne Convention for the Protection of Literary and artistic works in International intellectual property Law (hereinafter referred to as the Berne Convention) as an example, from the perspective of sociolinguistics, based on Halliday's theory of systemic functional linguistics.The linguistic features of legal language are found by analyzing the linguistic features of these phenomena.From the perspective of Halliday's systemic functional linguistics, this paper makes a functional stylistic analysis of the linguistic characteristics of the Berne Convention in terms of clause level and discourse level.This paper analyzes the characteristics of thematic system from textual function, mood system from interpersonal function, text and transitivity system from conceptual function and the characteristics of process and voice from conceptual function.The linguistic characteristics of the text are analyzed from the aspects of font and vocabulary, grammatical metaphor, cohesion system and situational context.The conclusion of this paper is that the legal language has the characteristics of authority, accuracy, simplicity, neutrality, coherence and conservatism, and the power of the legal language is reflected by the above linguistic characteristics.And from the language system to make the corresponding functional choice and form.In this paper, the study of the legal language characteristics of the Berne Convention is an interdisciplinary study of linguistics and law using the theory of systemic functional linguistics.The author hopes that through the results of this research, language learners will become familiar with the legal profession, on the other hand, it will enable legislators, administrators and relevant professionals engaged in intellectual property rights to better understand.Master and apply the Berne Convention to protect China's intellectual property rights more effectively and coherently.
