【摘要】：中国正处于转型复兴的关键时期，法治建设也伴随着这个时期经济社会发展和改革开放的历史进程发生着深刻变化。本文以改革开放以来的中国法律文化发展为主题，以转型为主线，，在对法律文化深度转型有一个全景式的描述和背景分析的基础上，着重梳理法律理论转型、法律制度转型和法律实践转型的脉络，对司法独立、多元法律体系、“活法”、立法民主化等一些法治建设中的重点关节进行较为客观详细的考察，试图描绘出一幅脉络清晰且血肉丰满的图画，在这幅图画中我们不仅可以清楚地看到这个时期的客观变化，更为重要的是可以从这些变化中总结出一些规律，以此为基础，对把握未来中国的法治发展走向及重点任务进行探索，以期为各方提供一些预测和参考。
[Abstract]:China is in the crucial period of transformation and rejuvenation, and the construction of rule of law is accompanied by profound changes in the historical process of economic and social development and reform and opening up.This article takes the development of Chinese legal culture since the reform and opening up as the theme, takes the transformation as the main line, on the basis of a panoramic description and background analysis of the deep transformation of the legal culture, focuses on combing the transformation of the legal theory.In the context of the transformation of the legal system and the legal practice, the author makes an objective and detailed investigation of the key joints in the construction of the rule of law, such as judicial independence, pluralistic legal system, "living law", and the democratization of legislation, etc.Trying to draw a picture of a clear and fleshy picture, in which we can clearly see not only the objective changes of this period, but also, more importantly, that we can sum up some laws from these changes as a basis for this.This paper probes into the development trend and key tasks of China's rule of law in the future in order to provide some prediction and reference for all parties.
