儒家文化的主要思想对当代中国法治建设的影响研究

【摘要】： 法律作为思想的社会关系和社会意识的存在形式之一,自它产生以来,就与所处的时代的历史文化具有不可分割的联系,并彰显出文化上的延续性。儒家文化是中国传统文化的重要组成部分,甚至在某种程度上成为中国传统文化的代名词,其典籍之多,研究者之众,是中国其他文化传统所无法比拟的。儒家文化,尤其是其主要思想,已经渗透到中国人思维意识的深层,体现于中国人的言谈举止之中。基于以上种种,当代中国进行法治建设的过程,无时无刻不受到儒家文化主要思想的影响,其中,既有正面的、积极的影响,也有负面的、消极的影响。如何剔除糟粕、取其精华；如何立足于本土文化,并借鉴外来法治文明的成果,这需要我们辩证的思考问题,冷静的加以分析,这也是本文所要研究的重要问题。本文分为四部分：第一部分主要阐述儒家文化主要思想的历史回顾；第二部分为当代中国的法治历程；第三部分为儒家主要思想对中国法治建设的影响,以及儒家文化主要法律思想与西方文化主要法律思想的对比分析；第五部分为充分发掘儒家文化主要思想积极的法治价值。儒家文化作为一种传统的文化力量,具有深厚的社会基础,它的主要思想存在于、并植根于普通民众的意识、心理、习惯、行为方式及生活过程之中,甚至在某种程度上获得了社会公众的普遍信仰。我国的法治建设也必须是由下而上才能从根本上确立真正的和谐的法治社会,因此,在我国进行法治建设的过程中,儒家文化主要思想的影响力不容忽视。
[Abstract]:Law, as one of the forms of social relations and social consciousness of thought, has been closely related to the history and culture of the times since its emergence, and has demonstrated the continuity of culture.Confucian culture is an important part of Chinese traditional culture, even to some extent become the synonym of Chinese traditional culture.Confucian culture, especially its main thought, has penetrated into the deep level of Chinese thinking consciousness and embodied in Chinese speech and behavior.Based on the above, the process of the construction of the rule of law in contemporary China is influenced by the main thoughts of Confucian culture all the time, including positive, positive, negative and negative influences.How to eliminate the dross and select the essence; how to base on the local culture and learn from the achievements of foreign civilization of rule of law requires us to dialectically think and calmly analyze, which is also an important issue to be studied in this paper.This paper is divided into four parts: the first part mainly expounds the historical review of the main thoughts of Confucian culture; the second part is the history of the rule of law in contemporary China; the third part is the influence of the main Confucian thoughts on the construction of the rule of law in China.The fifth part is to fully explore the positive legal value of the main thoughts of Confucian culture.As a traditional cultural force, Confucian culture has a deep social foundation. Its main thoughts are rooted in the consciousness, psychology, habit, behavior and life process of ordinary people.To some extent, it even gained the general belief of the public.The construction of the rule of law in our country must also be from the bottom up to establish the real harmonious society of the rule of law fundamentally. Therefore, in the process of the construction of the rule of law in our country, the influence of the main thought of Confucian culture can not be ignored.
