【摘要】:应当结合激励理论和财产权劳动理论来确定知名商品特有包装、装潢的归属;知名商品的判断除了应当考虑商品销售地域、销售时间、销售量、销售对象、广告持续时间、程度和地域范围等因素外,还应当考虑商品所使用的原材料、本身包含的成分、商品包装装潢、生产厂家等因素;商标权许可使用合同终止后,原商标权许可人和被许可使用人都负有防止混淆的义务;合同未明确约定财产权益的归属时,应当按照民法中的公平原则确定其归属。
[Abstract]:The specific packaging and decoration of well-known commodities should be determined by combining the incentive theory and the labor theory of property rights; the judgment of well-known commodities should take into account, in addition to the region of sale, the time of sale, the sales volume, the object of sale, and the duration of the advertisement,In addition to such factors as degree and geographical scope, factors such as the raw materials used in the commodity, the ingredients contained therein, the packaging and decoration of the commodity, the manufacturer, and so on, shall also be taken into account; after the termination of the contract for the licensing of the use of the trademark,Both the original licensor and the licensed user have the obligation to prevent confusion; if the contract does not clearly stipulate the attribution of property rights and interests, it should be determined according to the principle of equity in civil law.
