【摘要】：自古以来,中华民族就是一个多民族国家,各民族在历史长河中,共同劳动繁衍生息在祖国的大地上,创造了灿烂的中华文化和文明。西北少数民族对缔造伟大祖国做出了卓越的贡献,与此同时,也形成了自身独具特色、多姿多彩的民族文化。在民族文化中,法律文化是其重要的组成部分,法律文化也有自身相对独特的文化形式、载体和实现方法。西北各少数民族法律文化的生成不仅是其所属时代阶级性的要求,也与一个民族的心理、生产方式、宗教信仰密切相关。本文以马克思列宁主义、毛泽东思想、邓小平理论为指引,结合党的各民族平等、团结和共同繁荣的原则,研究我国西北少数民族地区法律文化建设。 文章主体分为五部分：绪论,介绍了本文研究的意义、国内外研究现状和文章的研究方法；第一章,基础理论问题研究,介绍了相关基本概念、西北少数民族地区法律文化的特点,对西北少数民族地区法律文化建设的理论认识；第二章,西北少数民族地区法律文化的发展现状及存在的主要问题,主要从西北少数民族地区法律文化的发展现状及成功经验,西北少数民族地区法律文化及存在的主要问题及原因分析两方面展开；第三章,西北少数民族地区法律文化建设的国际视野,分别介绍了英美法系、大陆法系、伊斯兰法系法律文化的形成及对我国的借鉴；第四章,构建西北少数民族地区法律文化的基本思路,分别从遵循宪法、维护法制统一,明确西北少数民族地区法律文化建设的目标,健全相关立法,突出地方立法和民族自治地方立法的作用,保障人权、进一步加强和完善民族区域自治制度,加强民族地区现代化教育,促进现代法律文化的生成和发展,强化政府在法律文化建设中的责任六个方面展开了论述。
[Abstract]:Since ancient times, the Chinese nation is a multi-ethnic country, all nationalities in the long river of history, the common labor and reproduction in the motherland on the earth, created a brilliant Chinese culture and civilization. Northwest ethnic minorities made outstanding contributions to the creation of the great motherland, at the same time, they formed their own unique and colorful national culture. In national culture, legal culture is an important part of it. Legal culture also has its own relatively unique cultural form, carrier and realization method. The formation of the legal culture of the ethnic minorities in Northwest China is not only the requirement of the class character of the times to which they belong, but also closely related to the psychology, production mode and religious belief of a nation. Under the guidance of Marxism-Leninism, Mao Zedong's thought and Deng Xiaoping's theory, combined with the principle of equality, unity and common prosperity of all nationalities of the Party, this paper studies the legal and cultural construction of ethnic minority areas in Northwest China. The main body of the article is divided into five parts: introduction, introducing the significance of this study, the domestic and foreign research status and research methods, the first chapter, basic theoretical research, introduced the relevant basic concepts, The characteristics of the legal culture in the northwest minority areas, the theoretical understanding of the legal culture construction in the northwest minority areas, the second chapter, the development status and the main problems of the legal culture in the northwest minority areas, Mainly from the northwest minority areas legal culture development status and successful experience, northwest minority areas legal culture and the main problems and reasons analysis two aspects; chapter three, The international field of view of legal culture construction in northwest minority areas, respectively, introduces the formation of legal culture of Anglo-American law system, civil law system and Islamic law system and its reference to our country. The basic ideas of constructing the legal culture in the northwest minority areas include following the constitution, maintaining the unity of the legal system, clarifying the goal of the legal culture construction in the northwest minority areas, and perfecting the relevant legislation. Stressing the role of local legislation and legislation in ethnic autonomous areas, safeguarding human rights, further strengthening and perfecting the system of regional national autonomy, strengthening modernization education in ethnic areas, and promoting the formation and development of modern legal culture, Strengthening the responsibility of the government in the construction of legal culture is discussed in six aspects.
