【摘要】： 反腐倡廉既是完善党建的重要方面,又是关乎社会主义现代化建设的重大政治问题。十六大以来,特别是十七大的召开,党中央明确反腐倡廉建设的基本要求,强调法制建设在推进和完善惩治和预防腐败体系中的重要作用。本文梳理了中国共产党反腐倡廉法制建设的历程及成就,指出新世纪反腐倡廉法制建设方面存在的问题并从经济、政治、文化以及法现代化的角度分析原因,参照《建立健全惩治和预防腐败体系2008——2012年工作规划》,试从完善党内民主和党内监督制度、完善规范国家工作人员从政行为的制度、完善违纪行为惩处制度、完善反腐败领导体制和工作机制的具体制度、加强反腐倡廉国家和地方立法工作、加强倡廉法制建设及加快反腐倡廉法制建设的国际接轨七个方面构建反腐倡廉法制建设体系,以期将反腐倡廉建设的理论和实践纳入法制的深层面,并推进依法治国方略的实施。
[Abstract]:Anti-corruption is not only an important aspect of improving the Party building, but also a major political issue related to socialist modernization. Since the 16th National Congress, especially the 17th National Congress, the CPC Central Committee has made clear the basic requirements of anti-corruption construction and emphasized the important role of legal system in promoting and perfecting the system of punishing and preventing corruption. This paper combs the course and achievement of the legal construction of the Communist Party of China in combating corruption and advocating honesty, points out the problems existing in the construction of the anti-corruption legal system in the new century, and analyzes the reasons from the angle of economic, political, cultural and legal modernization. With reference to the work Plan of establishing and perfecting the system of punishing and preventing Corruption from 2008 to 2012, this paper tries to perfect the system of inner-party democracy and inner-party supervision, to perfect the system of standardizing the political behavior of state functionaries, and to perfect the punishment system for violations of discipline. Perfecting the concrete system of anti-corruption leadership system and working mechanism, strengthening the national and local legislation against corruption and advocating honesty, strengthening the construction of the legal system for fighting corruption and speeding up the international integration of the building of the legal system against corruption and advocating honesty, and constructing a legal system for combating corruption and promoting clean government, The aim is to bring the theory and practice of anti-corruption construction into the deep level of legal system and to promote the implementation of the strategy of governing the country according to law.
