社会主义和谐法治建设探析

【摘要】： 和谐社会不仅是人类共同的美好社会理想,也是我们国家和党的奋斗目标。唯物主义告诉我们和谐社会不会自发实现。和谐社会的实现离不开和谐法治建设。法治是和谐社会实现的制度保障。和谐社会首先是法治社会,和谐社会实现的基本前提是法治和谐,也可以说法治和谐是和谐社会实现的基本保障。因此在构建社会主义和谐社会的背景下,和谐法治建设显得非常必要。具有中国特色的和谐社会,是应该是一个以人为本的社会;一个权力公正的社会;最终必然是一个“良法善治”的法治社会。处于社会全面转型时期的中国社会的和谐,应该是在国家权力与公民权利互动状态下形成的“和谐”。社会和谐的实现真正依赖的是对法律的信仰。只有法律成为信仰,社会才能在一个共同规则中和谐运转。目前我国法治建设存在法律体系内部不和谐、人权保障不充分、公权力和私权利失衡及缺乏法律信仰的不和谐现象。要想实现和谐法治,必须做到以下几点:首先,坚持科学立法,完善立法机制。其次,完善依法行政机制,推动依法行政,促进法治建设,维护社会正义。强化监督机制,确保权力公正。最后,加强法治教育,弘扬法治精神。只有这样才能最终走向一个公平正义、诚信友爱、充满活力、安定有序、人与自然和谐相处的社会,一个多元互动、理性人本的社会主义和谐社会。全文除引言外共分为四个部分。导言部分作者表明了和谐社会与和谐法治建设的良性互动关系。和谐社会离不开和谐法治建设,和谐法治是实现和谐社会的必然途径。和谐社会是和谐法治建设的目标。和谐法治发展的最终目标就是实现民主法治、公平正义、诚信友爱、充满活力、安定有序、人与自然和谐相处的社会。第一部分,和谐法治建设概述概述,主要阐述了和谐法治的概念;第二部分,我国法治建设存在的不和谐因素及原因分析,主要阐述了我国法治建设存在的几大不和谐因素并分析其产生的原因;第三部分,社会主义和谐法治建设的中心环节。第四部分,完善我国社会主义和谐法治建设的构想。通过全文五个部分的阐述,将我国的法治建设进行了浅要的分析,指出了当前法治建设存在的的主要不和谐问题并对今后的和谐法治建设二提出了自己的看法。
[Abstract]:Harmonious society is not only the common ideal of human beings, but also the goal of our country and party. Materialism tells us that a harmonious society will not be realized spontaneously. The realization of harmonious society is inseparable from the construction of harmonious rule of law. The rule of law is the institutional guarantee for the realization of a harmonious society. The harmonious society is the society ruled by law first, the basic premise of the realization of the harmonious society is the harmony of the rule of law, it can be said that the harmony of the rule of law is the basic guarantee of the realization of the harmonious society. Therefore, under the background of constructing socialist harmonious society, the construction of harmonious rule of law is very necessary. A harmonious society with Chinese characteristics should be a people-oriented society, a society of power and justice, and ultimately a society ruled by law with "good law and good governance". The harmony of Chinese society, which is in the period of social transformation, should be formed under the state of interaction between state power and civil rights. The realization of social harmony really depends on the belief of law. Only when the law becomes faith can society function harmoniously in a common rule. At present, there is disharmony within the legal system, inadequate protection of human rights, imbalance between public and private rights and lack of legal belief in the construction of the rule of law in China. To achieve harmonious rule of law, we must do the following: first, adhere to scientific legislation, improve the legislative mechanism. Second, improve the mechanism of administration by law, promote administration by law, promote the construction of rule of law, and safeguard social justice. Strengthen the supervision mechanism to ensure that power is fair. Finally, strengthen the education of the rule of law and carry forward the spirit of the rule of law. Only in this way can we finally move towards a society of fairness and justice, honesty and fraternity, vigor, stability and order, harmonious coexistence between man and nature, and a harmonious socialist society with multiple interactions and rational humanism. In addition to the introduction, the full text is divided into four parts. In the introduction part, the author shows the positive interaction between harmonious society and harmonious legal construction. Harmonious society is inseparable from the construction of harmonious rule of law, and harmonious rule of law is an inevitable way to realize harmonious society. Harmonious society is the goal of harmonious legal construction. The ultimate goal of the development of harmonious rule of law is to realize the democratic rule of law, fairness and justice, honesty and fraternity, vitality, stability and order, harmony between man and nature. The first part is an overview of the construction of harmonious rule of law, mainly expounds the concept of harmonious rule of law, the second part, the construction of the rule of law in China's disharmonious factors and reasons for analysis, This paper mainly expounds several disharmonious factors existing in the construction of the rule of law in our country and analyzes the reasons for their emergence. The third part is the central link of the construction of the socialist harmonious rule of law. The fourth part, consummates our country socialism harmonious rule of law construction idea. Through the elaboration of five parts of the full text, this paper makes a brief analysis of the construction of the rule of law in our country, points out the main disharmonious problems existing in the construction of the rule of law at present, and puts forward his own views on the construction of the harmonious rule of law in the future.
