从山东政法学院的办学历程看新中国法律教育的经验教训及其对策

【摘要】: 摘要内容:百年大计,教育为本。一个国家或一个地区法律教育的发展程度,与这个国家或地区法制的完备程度、法律的发达程度、人们对法律职业的态度有着密切的关系,在一定意义上已经成为衡量社会文明进程和法治建设进程的重要标志。法制的现代化需要法律人才的现代化;法律人才的现代化需要法律教育的现代化。山东政法学院的发展历程,可以说是新中国成立之后中国法律教育和法制进程的一个缩影,不仅可以从一个小的角度反映出新中国法律教育的发展状况,而且在一定程度上也折射出了新中国的法制发展进程。从山东政法学院的建立、发展过程中,我们可以总结出很多法律教育经验,为中国现代法制教育提供许多有益的借鉴,提出若干发人深省的思考。 本文首先依据山东政法学院发展的阶段性特点回顾了其发展历程,主要分为1955-1961年的“山东政法学院”、1979-1982年以短期培训为主的“山东政法学院”、1983-1988年开始学历教育的“山东政法学院”、1989-1996年开展专科升本科教育的“山东政法学院”、1997-2005年提出改建设想并为之奋斗的“山东政法学院”、2005年至今的山东政法学院等6个阶段。 其次,由于法律教育制度作为政法干部队伍的培养选拔制度,既是中国高等教育制度的组成部分,又是我国司法制度的重要内容;法律教育工作既是一项教育工作,更是政法工作的重要组成部分,因此,山东政法学院近半个世纪的高等法律教育的发展历程,为我国法律教育事业的改革与发展积累了丰富的经验,主要包括法律教育与办学必须大力加强领导班子建设,适时调整发展目标,走特色发展之路;法律教育与办学必须走多层次、多形式、多渠道的办学之路;法律教育与办学必须注重理论与实践相结合;法律教育与办学必须注重交流与合作;法律教育与办学必须加强思想政治工作;法律教育必须注重科研工作等6个方面。 法律教育是培养法律人才的重要工作,而法律人才是建设法治国家的第一资源。从这个意义上讲,今日中国的法律教育将决定明日中国的法治建设。所以,本文最后从山东政法学院的法律教育与办学实践中引申出若干对于我国现阶段法律教育与办学的思考,如应该注重内涵发展,不能盲目跟进、应该注重人的全面发展、应该注重改革与创新、应该依据自身的条件和特色适度发展、在与实践相结合方面还应加大力度等等,或许有助于认识新时期法律教育面临的历史背景、肩负的历史使命,有助于明确法律教育的发展方向和奋斗目标,有助于理解法律教育的培养标准,培养规格和培养要求,有助于分析法律教育存在的突出问题,有助于完善和健全法律人才宏观培养模式,并进而形成法律职业共同体和法律人才培养共同体之间的良性互动。
[Abstract]:Absrtact: education is the foundation of a hundred-year plan. The degree of development of legal education in a country or region is closely related to the degree of completeness of the legal system in this country or region, the degree of legal development, and the attitude of people towards the legal profession. In a certain sense, it has become an important symbol to measure the progress of social civilization and the construction of the rule of law. The modernization of legal system requires the modernization of legal talents, and the modernization of legal talents requires the modernization of legal education. The course of development of the Shandong Institute of political Science and Law can be said to be a microcosm of China's legal education and legal process after the founding of New China. It can not only reflect the development of legal education in New China from a small angle. Moreover, to some extent, it also reflects the development process of the new China's legal system. In the course of the establishment and development of Shandong Institute of political Science and Law, we can sum up a lot of experience of legal education, provide many useful references for China's modern legal education, and put forward some thought-provoking thoughts. This paper first reviews the development process of Shandong Institute of political Science and Law according to the stage characteristics of its development. "Shandong Institute of political Science and Law" from 1955-1961 to "Shandong Institute of political Science and Law" from 1979-1982 to "Shandong Institute of political Science and Law" from 1983-1988 and "Shandong Institute of political Science and Law" from 1983-1988. "Shandong Institute of political Science and Law" from 1989 to 1996 From 1997 to 2005, Shandong Institute of political Science and Law (Shandong Institute of political Science and Law) and Shandong Institute of political Science and Law (Shandong Institute of political Science and Law) were put forward and worked for. Secondly, as the training and selection system of the contingent of political and legal cadres, the legal education system is not only an integral part of China's higher education system, but also an important part of our judicial system. It is also an important part of the work of politics and law. Therefore, the course of the development of higher legal education in Shandong Institute of political Science and Law in the past half century has accumulated rich experience for the reform and development of the cause of legal education in our country. It mainly includes legal education and running a school must strengthen the construction of leading group, adjust the development goal in time, and take the road of characteristic development, the legal education and running a school must take a multi-level, multi-form, multi-channel way of running a school. Legal education and school running must pay attention to the combination of theory and practice, legal education and school running must pay attention to communication and cooperation, legal education and school running must strengthen ideological and political work, and legal education must pay attention to scientific research work. Legal education is an important work to train legal talents, and legal talents are the first resource to build a country ruled by law. In this sense, legal education in China today will determine the construction of the rule of law in China tomorrow. Therefore, from the practice of law education and running school of Shandong University of political Science and Law, this paper draws some thoughts on the present stage of legal education and running of our country, such as paying attention to the development of connotation, not blindly following up, and paying attention to the all-round development of human beings. We should pay attention to reform and innovation, develop appropriately according to our own conditions and characteristics, and strengthen our efforts in combining with practice, etc., which may help to understand the historical background and historical mission of legal education in the new period. It is helpful to clarify the development direction and goal of legal education, to understand the training standards, training specifications and requirements of legal education, and to analyze the outstanding problems in legal education. It is helpful to perfect and perfect the macro training mode of legal talents, and then form the positive interaction between the legal professional community and the legal talent training community.
