标准必要专利“合理无歧视”许可费计算的原则与方法——美国“Microsoft Corp.v.Motorola Inc.”

【摘要】：美国近期"Microsoft Corp.v.Motorola Inc."一案地区法院的判决为标准化组织的合理无歧视许可原则下许可费的计算提供了有益参考。"合理无歧视"许可是标准化组织与参与标准制定者之间的合约,因此应在理解合理无歧视许可背景的基础上,依照合同目的来解释"合理"与"无歧视"的具体含义,并以此作为计算合理无歧视许可费的基本原则。在符合合同目的这一原则下,合适的合理无歧视许可费计算方法应有利于建立先进标准以及促进标准的推广,专利本身对标准及标准实施者产品的价值贡献是决定许可费的关键因素,可以采用"基础许可费+调整"的方法计算许可费。
[Abstract]:The United States recently "Microsoft Corp.v.Motorola Inc." The decision of the District Court in the first case provides a useful reference for the calculation of the licence fee under the reasonable and non-discriminatory licensing principle of the ISO. " Reasonable non-discrimination permits are contracts between ISO and participating standard-setters. Therefore, the specific meaning of "reasonable" and "non-discrimination" should be interpreted in accordance with the purpose of the contract, based on an understanding of the background of reasonable non-discrimination permits. And this as a reasonable non-discrimination licensing fee calculation of the basic principle. Subject to the principle of conformity with the purpose of the contract, an appropriate method of calculating reasonable and non-discriminatory licensing fees should facilitate the establishment of advanced standards and the promotion of such standards, The value contribution of patent itself to standard and standard implementer's product is the key factor to determine the license fee. The method of "adjusting the basic license fee" can be used to calculate the license fee.
