中国自主性地方性法规创制研究

【摘要】： 地方立法在我国的立法体制中占有重要的地位,是中央立法的必要补充。目前,我国有地方立法文件17万余件,其中自主性地方性法规占有一定的比例,这些法规弥补了中央立法的不足,为中央立法提供了许多经验,为地方社会经济文化的发展提供了有力的法制保障,是建设中国特色社会主义法制体系的重要组成部分。但由于地方立法的观念意识、认识程度、技术水平等都有较大区别,且缺乏一个明确的立法标准,因此,我国自主性地方性法规的质量也是良莠不齐,有较大的区别,甚至有些自主性地方性法规还存在一定的合法性问题。文章试图对我国自主性地方性法规创制的完善提出一些建设性意见,并同时针对自主性地方性法规创制的相关理论和现状进行分析和探讨。首先,对自主性地方性法规创制的法理基础进行了探讨,通过对其概念、法理依据、具体功能的分析,论述其存在的必要性和作用,为本文研究自主性地方性法规创制做好铺垫。其次,分析了我国自主性地方性法规创制的现状,通过对自主性地方性法规的发展沿革、立法时机选择情况、形式选择情况、立法原则遵循情况、立法权限的遵守情况进行分析,指出我国自主性地方性法规创制存在的缺陷和不足,并分析了由此导致的地方立法的滞后和法规实施的困难。最后,根据我国自主性地方性法规创制的实际情况,结合国外的先进经验,针对立项机制和创制程序两个关键问题,提出完善中国自主性地方性创制的建议。
[Abstract]:Local legislation plays an important role in our legislative system and is a necessary supplement to central legislation. At present, there are more than 170000 local legislative documents in China, of which autonomous local laws and regulations account for a certain proportion. These laws and regulations make up the deficiencies of central legislation and provide many experiences for central legislation. It provides a strong legal guarantee for the development of local social economy and culture and is an important part of building the legal system of socialism with Chinese characteristics. However, due to the great differences in the concept and consciousness of local legislation, the degree of understanding, the level of technology, and the lack of a clear legislative standard, the quality of autonomous local laws and regulations in our country is also mixed, with great differences. Even some independent local laws and regulations still have certain legitimacy question. This paper attempts to put forward some constructive suggestions on the improvement of the creation of autonomous local laws and regulations in China, and at the same time, analyzes and discusses the relevant theories and present situation of the creation of autonomous local laws and regulations. First of all, the author discusses the legal basis of the creation of autonomous local laws and regulations, and discusses the necessity and function of its existence through the analysis of its concept, legal basis and specific functions. For the study of autonomous local laws and regulations to create a good platform. Secondly, it analyzes the current situation of the creation of autonomous local laws and regulations in China, through the development of autonomous local laws and regulations, legislative timing selection, form selection, legislative principles follow. This paper analyzes the compliance of legislative authority, points out the defects and deficiencies in the creation of autonomous local laws and regulations in China, and analyzes the lag of local legislation and the difficulties in implementing laws and regulations. Finally, according to the actual situation of autonomous local laws and regulations in our country, combined with the advanced experience of foreign countries, and aiming at the two key problems of project establishment mechanism and creation procedure, the paper puts forward some suggestions to perfect the autonomous local creation system in China.
